The issue will be, what constitutes "capital rape".
There is "classic rape" ( the "submit or I will kill you" kind), and that is already subject to severe penalties.
Then there is "new age" rape, the "I had a few drinks, and while conscious and aware, I was too drunk to make a good decision" rape (where the man being equally drunk and not making good decisions is NOT a mitigating factor).
And then there's the "He didn't call me in the morning, that SOB! I would NEVER have consented if I knew that's how he would behave!" revenge false-accusation of rape.
Would you ALSO advocate execution of the woman, if her accusation turns out to be false?
Contraception was mainly desired by women.
It facilitates a woman having a relationship with a desirable man, a man who would NOT be interested in her if he had to MARRY her in order to get in bed with her, or if he might be at risk of 18 years of child support.
What we used to have, was women mostly getting married before 25, to the best man they could get to agree to marry them, even if he wasn't "Prince Charming". For most, their choices were limited to stable "beta male" types.
What we now have, is women spending their 20's-to-early-30's having sex with the most exciting "alpha males" they can get, using contraception because they know Prince Charming is not going to marry them (the "Sex and the City" fantasy). Then, in their 30's, deciding to leave the party circuit, marry some stable, employed "beta male", have a few kids, then after a while divorce him (because he's boring and unexciting) and take his assets and income.

In real life, as opposed to fantasy, Cruz currently is just not getting traction. Maybe that will change by the actual primary elections.

This guy was a criminal, EVIL man. But this made him EXCITING to many women (as you observed), and thus he impregnated many. It doesn't matter that 99.9+% of the male population are not murderous gang members, IF the gang members who JUST DON'T CARE get to have unprotected sex with lots and lots of girls who find them "exciting".
A century ago, hell even 70 years ago, the girl's father would have ensured such a man never got NEAR his daughter, even if it took ensuring that the guy was mysteriously never seen again.

He and men like him have cost the taxpayers thousands and thousands and millions of dollars in rehab that never took and who knows what all, support for the women they impregnate and their offspring. Women are just as guilty, too, for enabling and helping them. Maybe moreso.

The only rape that is capital rape is given by your fist example. The others are pure bullsh*t.
In any case of accused rape, where the woman is proven to have committed perjury, the penalty should be 10 years prison time - w/o exception, and w/o possibility of parole.
That penalty should be sufficient to dissuade any further escalation of the problem.

That would depend on whether the accused had been executed. If not, then I would exact a penalty of 10 years jail time - without possibility of parole - for the accuser. If, OTOH, the accused had been executed b/c of perjured testimony, then I would execute the woman as well, since she is guilty of conspiracy to murder.
