Ted Cruz rips jailing of Kim Davis: ‘This is not America’

GOP presidential hopeful Ted Cruz criticized a federal judge for ordering a Kentucky county clerk to be jailed after she defied the Supreme Court by refusing to issue marriage licenses to gay couples.

The Texas senator said he “unequivocal” stands with Kim Davis, who was put in federal custody for contempt after testifying before Judge David L. Bunning Thursday that marriage is between one man and one woman.

“Today, judicial lawlessness crossed into judicial tyranny,” Mr. Cruz said in a statement. “Today, for the first time ever, the government arrested a Christian woman for living according to her faith. This is wrong. This is not America.”

Ms. Davis, a Christian, has maintained that she could not issue marriage licenses to same-sex couples based on her religious beliefs.

Judge Bunning, who was appointed by President George W. Bush, said in court Thursday that Ms. Davis’s “good-faith belief is simply not a viable defense.”

“It’s not physically impossible for her to issue the licenses,” he said, The New York Times reported. “She’s choosing not to.”

On Thursday. Mr. Cruz said the nation was founded on “Judeo-Christian values” and said it is hypocritical for elected officials to on the one hand argue that Ms. Davis should resign from her job, but on the other hand refuse to call for the mayor of San Francisco to step down for creating a sanctuary city for illegal immigrants.

“Where is the call for President Obama to resign for ignoring and defying our immigration laws, our welfare reform laws, and even his own Obamacare?” he said. “When the mayor of San Francisco and President Obama resign, then we can talk about Kim Davis.”

Other GOP presidential candidates also panned the decision.

THIS is an issue to ride all the way to November 2016, if I've ever seen one - an American woman in flyover country jailed for legally exercising her faith.

And most of the rest of the GOP field won't touch it with a ten foot pole.

If the clerk don’t want it issue gay marriage licenses, she should be moved to a position in the clerk’s office that doesn’t deal with marriage licenses. This happens occasionally with prosecutors and judges who have objections to the death penalty. They don’t handle such cases, even if other prosecutors and judges do.

The clerk’s office must comply with the law. The clerk’s office should reassign their employee. Putting her in jail is ridiculous.

You know the best way to stand with Kim? PEOPLE OF KENTUCKY: Submit a signed referendum in Kentucky for a special ballot (I don’t care how much it costs, it’s worth it) to outlaw the unconstitutional federal act of overturning Kentucky’s anti-gay-marriage laws with the State of Kentucky pledging to protect its citizens from this unconstitutional federal tyranny.

Well there’s a complication in that she was elected to that position and is the head of that office. And if she really believes what she says she believes she simply can’t reassign the job to someone else to do her dirty work.

That’s like saying I refuse to do abortions, I assign you to do it... In the moral perspective it’s a distinction without a difference. You are ordering the abortion one way or the other.

The religion is secular humanism. In the name of the new pagan religion the government will now force all Christians to bow to the new pagan religion, your business will be forced to close, you will lose your job, and your kids will be forced to accept perversity in the schools. Kneel and bow down, or accept the penalties; lost business, lost jobs, lost income, jail.

How is this “mealy mouthed pro sodomy propaganda”, or is anyone who posts anything you don’t like so labeled?

My post accurately reflects the law, like it or not.

The next real fight, which we must win, is the right of those in the private sector to refuse to take part in ceremonies or behavior they have moral objections to. The church or baker should have the right to so refuse as conscientious objectors. The same applies to the right to refuse to participate in abortion or birth control or war.

I seriously doubt that the Supreme Court is going to change its mind here, protests on FR notwithstanding.

I suggest we stop fighting each other and to focus our energies on ensuring that the law guarantee this religious exception.
