How?

Many of the functions of the administrative state were created in response to demands of the people to manage particular risks attendant to the economies of scale attained through technology. Smoke from a local blacksmith was not a big deal, but US Steel was. There are similar economies of scale attendant to legal power by which means civil law broke down from the perspective of an individual attempting redress from US Steel for poisoning their air. Something had to be done and this legacy of a 19th Century legal system we have now is what is at issue.

The problem is that air is a socialized commons, subject to the tragedy of same. The solution set is starts in private property and free association among the people by which to construct a common interest in managing their resources. What was impossible in the 19th century is for the people to possess reliable and accurate means to measure and account the costs of transformation products in said commons when they transit a property line. Such exist now. What remains is to automate transactions in dispersion rights and mitigations such that we can cut out the lawyers. You can find a more detailed discussion of these mechanics here.
