Time for a hard candy Christmas.
Obamacare is here to stay, more or less. Obamacare has won.
I can almost see the heads exploding, but consider a few facts that should be obvious now:
*In 2011, Obamacare had a furious opposition that put dozens of Tea Party conservatives in the House and Senate. It came to nothing. Ted Cruz was able in 2013 to briefly lead a shutdown of the gubment over some Obamacare funding, but even that failed. No major effort, no thoroughgoing "repeal Obamacare" measure has come before both the House and Senate for even a vote.
*In the meantime the Supreme Court, in two treasonous decisions, has cemented Obamacare as "the law of the land." We all know such laws can and have been repealed, but it adds one more layer.
*Now for the really bad news: Obamacare is so woven into the fabric of the whole health "care," hospital, insurance bureaucracy now that merely attempting to legislate the repeal of that aspect would constitute a colossal undertaking to unravel, every step accompanied by armies of lobbiests and media pressure.
*And even worse still, millions of people have now lost policies that will never be replaced and can never be replaced because in the interim many people have developed "conditions" that would now become "pre-existing conditions." Those who haven't? Well, insurance companies would likely find or invent some. And there is no way to reconstitute the policies themselves---even adjusting for the time lapse would be a staggering challenge---and no one can rebuild the insurance companies that have gone out of business or merged, or the companies that have dumped policies.
Like FDR, Zero knew that all he had to do was just get it in place, and sheer momentum of "the law of the land" would take over. The radical Marxist absolutely knew his stuff.
Note that not one of the Republican presidential candidates has favored "Repeal" only. None. Even Ted Cruz supports the " . . . and Replace" nonsense. It won't happen.
THEREFORE
We the People have no choice but a Constitutional Amendment. I welcome comments and thoughts, but my first take would be something like this:
Amendment 28 to the United States Constitution
"The government of the United States shall not provide medical care to any individual nor shall it provide insurance for said medical care to any individual.
A. The exception to the Amendment is the United States military, which shall continue to receive all medical care services through the United States Hospital Corps and Medical Corps; and all veterans of the United States military, who shall continue to receive medical care through the Veteran's Administration and its hospitals and care centers.
B. All employees of the United States government will be eligible for insurance coverage as negotiated by agents of the United States government, with the exception of the following:
1. the President of the United States, the Vice President of the United States, the members of the cabinet, the members of the United States House of Representatives, the members of the United States Senate, and the members of the United States Supreme Court;
2. and the staffs of the President, the Vice President, the members of the cabinet, the members of the United States House of Representatives, the members of the United States Senate, and the members of the United States Supreme Court.
And who in congress would vote for this?
You are right. It ain’t going nowhere.
Whenever a program goes fascist....government controls the people and corporate sponsors of pols profit from it....it never goes away.
How to get rid of it now? Vote to "keep ObamaCare but drop the mandate". Why? Next to nobody in DC could vote against that and be re-elected. When the 'pubs say "repeal and replace" what they mean is replace it with something that gives their paymasters even more profit. The only way we win is if market forces take over.

Cheating is not winning. And of course tyrants would claim the rule of man versus the rule of law to be the “law” of the land. It’s clear that this deformation/subversion of what the Founding Fathers established has become a “form of government (that has) become destructive of (the) ends” of safeguarding “life, liberty and the pursuit of happiness”, as the Declaration of Independence renders such things; if “the people” do not take hold of their “right … to alter or abolish it” but try to work within its narrow confines, naught will come of it, sorry to say.
Actually, I think this gets to one of the primary flaws in current thinking on insurance.
First flaw (which I think you are primarily addressing): Wouldn't it be fabulous if the US Government provided health care and/or insurance coverage for absolutely everyone??
People need to stop thinking like this.
Second flaw (which I perceive in your Article 28 Section B): We should rightly expect employers to provide health care and/or insurance coverage for their employees.
People need to stop thinking like this as well.
I would support a Constitutional Amendment that blocked the US government from getting involved in this area. I would also like to see insurance coverage provided solely from the open marketplace, with absolutely no tie to one's employer whether that be the US Military, or Netflix, or Joe's Auto Shop.
It's not the government's problem to solve.
It's not your employer's problem to solve.
However, IF you had a 2/3 majority of congress, since it would let them completely off the hook (as in Prohibition, or the Income Tax amendments) you might could pull it off. One reason the Income Tax amendment passed is that Congress really didn't have to craft a law. It just simply accepted the amendment. With Prohibition, all Congress had to do was the simple Volstead Act. The key to all amendments is simplicity, which keeps Congress out.
I have opposed a Constitutional Convention or convention of the states. But we're almost at that point, and I'm beginning to sense that the peasants with pitchforks are outnumbering the political class that would set the rules in such a convention.
If Trump is elected, believe me, Obamacare will be dismantled.
You just killed Medicare. Good luck with that.

How about this 28th Amendment:?
“No payments shall be made to any person or corporation except in compensation for services rendered to the nation.”
We’ve got to keep pressing the truth that for most Americans, Obamacare has brought inferior care at much higher priced and greater intrusion into our privacy. The only “plus” has been the ridiculous need for more government and crony capitalist employment in order to meet the mandates of the behemoth.
Without a clear public understanding of just how bad Obamacare is, we will be doomed to piecemeal non fixes that, in most cases, will make things worse and require more bureaucrats to administer.
A John Roberts or Anthony Kennedy could find a way around this by calling health-care "loving." The US Federal Government IS perfectly within-its-rights to provide LOVING.
The insurance companies would oppose ending the madate, and they have a lot of money to contribute. For the Repub leadership, money overrules principle.
It's unfixible. Stripping healthcare from seniors? There is not a single Senator or Congressman who would vote to send it for ratification, and not a single state which would ratify it.

Ooooh, that’s good. But wouldn’t the USSC just rule that health care was “rendered to the nation?” I think we have to get around that.
I just don't think we'll get there, because these "fixes" will keep coming until we get to single payer.
A Constitutional Amendment? To rescind the illegal? PPACA is illegitimate illegal garbage.
