Sowell: Supreme Court Disasters

Many people are looking at the recent Supreme Court decisions about ObamaCare and same-sex marriage in terms of whether they think these are good or bad policies. That is certainly a legitimate concern, for both those who favor those policies and those who oppose them.

But there is a deeper and more long-lasting impact of these decisions that raise the question whether we are still living in America, where "we the people" are supposed to decide what kind of society we want, not have our betters impose their notions on us.

The Constitution of the United States says that the federal government has only those powers specifically granted to it by the Constitution — and that all other powers belong either to the states or to the people themselves.

That is the foundation of our freedom, and that is what is being dismantled by both this year's Obamacare decision and last year's ObamaCare decision, as well as by the Supreme Court's decision imposing a redefinition of marriage.

Last year's Supreme Court decision declaring ObamaCare constitutional says that the federal government can order individual citizens to buy the kind of insurance the government wants them to buy, regardless of what the citizens themselves prefer.

The Constitution gave the federal government no such power, but the Supreme Court did. It did so by citing the government's power to tax, even though the ObamaCare law did not claim to be taxing.

I wonder when a future Supreme Court will come right out and say that “state’s rights” are unconstitutional and that the various state legislatures are ordered dissolved because they frustrate Federal authority?

Or are they really just going to go at piecemeal?

When Chief Justice Warren said that "separate educational facilities are inherently unequal," he was within walking distance of an all-black public high school that sent a higher percentage of its graduates on to college than any white public high school in Washington.

This is why I love reading Sowell. This thing - I think it used to be called "fact".

The issue is not just how far we have to kick the 10th Amendment to the curb, because it's already there. The issue is that somebody can, or won't, depending on how they feel at the moment, and it is neither up to the voters nor controlled by Congress. That's going to be a real problem because I could easily see Supreme Courts even more activist than now.

Well said. At the rate the Supreme Courts have been ignoring the 10th Amendment future courts without a doubt will become more activist.

I think it is dead. People are by and large ignorant of their Constitutional rights and guarantees. And there is no way to enforce the people’s will when the Constitutional means to do so have been successfully misappropriated by powerful elites.

People are by and large ignorant of their Constitutional rights and guarantees.

The Constitution guarantees that you can try and do the best you can for yourself and the people you care for, but you are the key. The more you learn, the more you strive, the more you try, the better you will do.

That is a model that the majority of people who live in America no longer find agreeable, and will support and fight for.

They want a different model, and the elites around the world will be happy to give it to them.

They would never be that honest. They would dress it up on poetic prose so that supporters have cover and dissenters are just speechless — left to wear bags over their heads in shame for what has become of this country.

There’s no reason to spoil the charade. Every state but Texas is already owned by the federal government. At the rate Mexicans and Californians are pouring in, Texas won’t hold out for long.

We the people of the United States do hereby re-charter our country in this year of some dead white guy, 2015.

Article 1: The President.

The President is in charge. He won. Get over it. You elected him and elections have consequences. He say, you do.

The President will be elected by popular vote every four years unless he declares otherwise since, as stated previously, he’s in charge.

Article 2. The Congress.

The people will elect representatives to go to Washington D.C. and spend the people’s money in whataver way these representatives see fit. If the people don’t like it, tough .They can try to replace their representatives by election if they can get past all the companies paying for the re-elections of the current representatives.

While the members of congress will be called representatives of the people, they will, in fact, be representatives of the corporations who pay the lobbyists to get laws passed to suit those corporations. Any benefit accrued to the people will be immaterial to the operation of the Congress.

Article 3. The Supreme Court
In the event the President or the Congress actually do something beneficial to the people, the Supreme Court will put a stop to it.

Article 4. The rights of the peope
What, you’re still reading this? Go back to your MTV and your video games. We’ll take care of it from here.

Well, at least half a million French hit the streets over opposition to homosexual marriage.

Heard of anyone hitting the streets since Friday? Been called about any protests? See any on the news?
