IMO, they would not DARE listen into or store this data or there would be lots of new millionaires.
HOWEVER, I would worry about “some governmental agency” COMPELLING them to do so, and then gagging their ability to disclose or complain about it.
We have systems that the Soviets could not even imagine in their wildest totalitarian dreams.
Even better, the victims actually buy the equipment themselves!!!

Left wing corporate fascists will do the NSA’s work for kickbacks and protections.
With a modern computing device, I sure don't see the need for audio packets to be routed to Google's central servers in order to process voice recognition commands.
The surveillance state has grown up right around us, and even the vigilant have been caught flat-footed.
Tho only solution I see is massive individual and class-actions suits which result in substantial judgements, as well as bringing criminal charges against those whose civil rights are being violated.
Any such technology or capability which would infringe on Privacy must be clearly noted, defaulted to opting out, etc.
Private individuals will simply have no chance unless a new, fierce attitude regarding protection of Civil Liberties under the Bill Of Rights exists. This is something that should unite everybody from all sides of the political spectrum who believes in protecting individual rights.
And those who are willing to 'fudge' their tolerance regarding such violations, simply because the situation in question doesn't directly apply to them a) should not do so and b) should be ashamed of themselves for tolerating something which can and will eventually be used again them.
This Tyranny has to be fought on every legal front. Throwing up our hands and giving up and just letting it slide is not an option.
