Undocumented Immigrant Faces New Obstacle to Bar Admission

An undocumented immigrant who was cleared by a Brooklyn appellate court to practice law in New York has run into a potential obstacle to joining the bar after an Iowa state judge sentenced him to one year of probation for trespassing during a political rally held on private property.

Cesar Vargas, 31, participated in a demonstration over immigration policies at a rally for Republican presidential candidates and others in Des Moines. He and other demonstrators sat among about 1,500 attendees on the private property.

At one point, he rose and disrupted a speech by New Jersey Gov. Chris Christie, asking if he would support the deportation of Vargas' 70-year-old mother if elected.

Aprilanne Agostino, the court clerk for the Appellate Division, Second Department, which granted Vargas' application to the bar on June 3, the day before he received his sentence for the trespassing charge, said there is no rule against granting admission to the bar to an applicant who is on probation.

However, it is required under Judiciary Law §90 that applicants possess the "character and general fitness requisite of an attorney." Thus, she said, the Second Department would need to conduct further review of the circumstances of his case.

"It's very rare that somebody is awaiting admission and gets put on probation," Agostino said.

Vargas, who immigrated from Mexico to the United States with his family when he was 5 years old, obtained his law degree from the City University of New York School of Law and passed the bar exam in 2011

Anyone think if he were a white American citizen who broke the law and disrupted a dem rally he'd be given all these second chances?

I still find it incomprehensible that any court or bar association would even entertain the notion that an ILLEGAL ALIEN can practice law in this country.

I cannot understand why liberals celebrate criminals and condemn productive people. However, that is what liberals do and that is why I despise them.

How does he expect to take an oath to ‘protect the Constitution of the United States’ when he is a known invader due to his parents’ actions?

He can’t be too bright if he brought up his grandmother who was granted favor in the “one and only” amnesty in the 80’s.
