If you mean the laws that forbid possession by a person illegally using drugs, it’s a federal offense for the son; and becomes an offense to dad only if dad knows the son is/continues to be an illegal user. I think dad is up the creek here, because his son was recently arrested for drug use. Dad will be charged, but might get off depending on testimony (if the jury believes a story that he thought his son was clean, etc.)
