Hatch should fix H1-B visa program instead of expand it

Corporate lobbyists have convinced legislators of both parties that America needs more guest workers in high-tech jobs. Leading the charge in Congress to do their bidding is Utah Sen. Orrin Hatch, who has introduced legislation to double or triple the number of non-immigrant tech workers who can be hired annually on H-1B visas. But his proposal won't fix the H-1B program's flaws, which allow American and foreign workers alike to be exploited and underpaid. A program that brings skilled, smart people from abroad to work in the United States can be a very good thing — but only if it's done fairly, and after giving U.S. workers a chance to be hired.

Many of the workers laid off at Disney and SCE earned $100,000 a year or more. Government data indicate the H-1B workers replacing them earn around $60,000.

The companies that usually do the actual replacement — offshore outsourcing firms like HCL, Infosys and Tata — are the top recipients of H-1B visas, and get about half the allotted visas every year. Their business model is based on replacing U.S. workers and shifting jobs overseas.

This OpEd pretty clearly shows what anyone who has looked into the situation knows, the H1B is a troubled program that has had a largely negative effect on American workers.

This is being done for corporations, to benefit them and boost profits, not for America. Our leaders are out for themselves only.

Any updates from Team Ted on his support for massive increases in this terrible program?

Unlike the TPP, which we have yet to see the details of, the horrors of H1B are well known to anyone interested in doing some basic research on it.

So I find Ted's position much more troublesome on this than his support for TPA/TPP.

From the candidates own "Ted Cruz for Senate" Web Site:

In 2013, Sen. Cruz proposed amendments to the “Gang of 8” bill that would strengthen border security, expand green card opportunities, increase high-skilled “H1B” visas, prevent illegal aliens from receiving welfare benefits, and enforce the rule of law.

It is my opinion that his unwillingness to revisit this position is costing him support, and is one reason he remains stuck in mid-pack in the race. (7th place in RCP poll average).

Just modify it to do what the Japanese do with their counterpart program for foreign workers:
  1. No quotas, just a demonstrated attempt to show you made a bonafide attempt to hire a native worker.
  2. Pay them a minimum 10% wage premium over the going wage for similar work in the same industry. This requirement alone limits gaming the system and hiring only workers who would command the premium.
  3. Eliminate the requirement that the imported worker stay with their company for more than a token amount of time, say six months. If they are really that good, then pay them enough so that nobody else takes them.

The system works very well in Japan. I was such a worker for 14 years, two different firms.

It could work here as well and might include a few tweaks such as an additional 5% surcharge to train American workers to do the job. Such a provision might be necessary here. It wasn't necessary in Japan since a concentration of foreign workers in a given industry tended to bring up the entire industry wage and salary structure and attract more Japanese workers.

I agree that it should be fixed meaning that the abuses should be ended.

Your post is very interesting. I double dog dare a politician to explain why the system you describe is not “fair” - and these days, they just LOVE “fair”.

Although I still believe that he is the smartest person in the Republican field, Cruz lost my interest after finding out more about his position on this.

Hatch should have been retired by the voters the way we retired the weasel Eric Cantor here in Virginia.

This is just another avenue for cheap labor importation.

The GOP is owned by The Cheap Labor Express.
