It’s possible he swallowed all the drugs he had on his person as he ran from police. Your scenario is definitely possible.
In a just world, when we had an impartial judiciary, she couldn’t. What we have now is a far from just World. And the judiciary is everything but impartial. So while she should not be able to, she is power and can do as she pleases.

Yeah....a toxicology report saying he’s loaded with PCP would really flip out the prosecution angle. Wouldn’t matter if you’d buckled him into the seat....he would have thrown his head around and done his own damage. This is why everyone should have waited for the full report to be done before rushing to some judgement.
