Patience Roggensack said there's no doubt she is chief justice

Patience Roggensack said Tuesday there is no doubt she is the Wisconsin Supreme Court's chief justice and that she didn't want to fight with any of her colleagues — in the process, taking jabs at how the court has been run.

The justice told conservative WTMJ-AM (620) radio host Charlie Sykes she had been meeting with top court staff in recent days and planned to allow them and other justices to have more input than they have in the past.

Roggensack did not respond to interview requests from the Milwaukee Journal Sentinel last week and did not immediately respond to one Tuesday, but she spent about 10 minutes Tuesday discussing the situation on the talk show, which promotes Republican campaigns and conservative causes.

They were her first public comments since a dispute erupted over who is leading the court. An attorney for longtime Chief Justice Shirley Abrahamson in court papers filed Friday contends Abrahamson still leads the court and that a vote for Roggensack by the court last week was invalid.

Roggensack told the radio host the most important of the chief justice's duties is setting the tone for the state's judiciary and she plans to establish a positive one for a court that has been ridiculed nationally in recent years for infighting.

"When I read the headline this morning in the Journal Sentinel, I was sad," Roggensack said, referring to a story headlined "Will the real chief justice please stand" in the print edition. (The story carried different headlines in different formats.)

"That is poking fun at the Wisconsin Supreme Court, trying to make a joke at our highest judicial institution. And you know that does a disservice to our state."

The dispute ~snip~ is playing out in a federal lawsuit brought by Abrahamson.

There is no precedent. The voters passed a Constitutional Amendment. Seniority rules are OUT! Roggensack is CJ, but Abrahamson won’t go quietly.

What sort of amendment? Would it apply ex post facto
or only when the previeous chief’s term ends?

Confusing.

Isn’t Abrahamson the one who accused another Justice of trying to kill her by strangulation when there were multiple witnesses to the event in question?

Constitutional amendment. Takes effect immediately, but that is what Abrahamson is arguing — that it shouldn’t take effect until HER 10 year term ends. It’s in the courts.

Don’t forget that the Wis SC precedent is that constitutional amendments are effective immediately unless otherwise specified in the amendment. The author of that precedent is — Shirley Abrahmson.
