Nice idea, but nitrogen asphyxiation will be challenged in the courts as being cruel and unusual punishment so it might be years before it could be used. However, using nitrogen for capital punishment would be relatively easy. Just have a cell reasonably air tight and pour in liquid nitrogen. The liquid nitrogen would quickly expand to gas and displace the oxygen. Unconsciousness would be almost instantaneous with death following in a few minutes. Because the air we breath is mainly nitrogen there would be no gasping or struggle.

70% of regular AIR is Nitrogen Gas or N2 gas.
They just replace the 30% that is O2 with more N2, so that the air the criminal breathes is 100% N2 and no oxygen.
Since the breath reflex is triggered by CO2 levels there is no strained breathing, just normal breathing until the O2 runs out and the inmate passes out and eventually passes away due to “Hypoxia” or lack of oxygen.
Fire supression systems in data centers that use “Halon” Gas are dangerous the same way, if the air is replaced with something non breathable you won’t notice until you start passing out.... Some peopel have died due to Halon Gas replacing the O2 and there was no panic they just drop in place.
Nitrogen Gas is used because it is both cheap and plentiful.
They could technically use Helium, or Halon, or Sulfur Hexaflouride, but that would be expensive.

Use Sulfur Hexaflouride, so if they talk they sound all evil like and less likely for the people gasing them to feel sympathy for the devil....

Maybe they should bring back R-12. It hugs the ground & displaces oxygen. Makes a heck of a refrigerant,too. Probably the best we ever had. Never did figure out how it got into the upper atmosphere,tho.

Give several atm of N2, plus enough admixed O2 to maintain life, and you get nitrogen narcosis aka “rapture of the deep.” Gradually cut the O2 and they’d die thinking they were going up. Cycle the N2 pressure with an artist like Tom Clancy’s John Clark in control and they’ll die certain they’ve gone down. Would be against the 8th, but then where are the penalties to government employees who break other parts of the constitution?
