(CNSNews.com) - The U.S. Justice Department is urging a federal court in Georgia to side with a prison inmate who was born male but wants to continue taking the "feminizing" hormone treatment that produces attributes "such as breasts and soft skin."
In a Statement of Interest filed in the case of Ashley Diamond, the Justice Department concluded that "Failure to provide adequate treatment for transgender inmates with gender dysphoria constitutes cruel and unusual punishment under the Eighth Amendment."
The case (Diamond v. Owens, et al.) has landed in U.S. District Court for the Middle District of Georgia.
At issue is whether the Georgia Department of Corrections may employ a so-called "freeze-frame" policy, which says inmates who are not identified as transgender and referred for treatment at the time they enter prison may receive no treatment for the condition once they end up behind bars.

Well by all means, they should receive the appropriate psychiatric treatment for their serious mental illness.
They could start with electroconvulsive therapy.

The DOJ has been a rogue agency for 6 years. Their opinions are so far removed from enumerated powers as to be meaningless.
What section of the Constitution gives special rights to the insane, the perverts and the indolent that all other citizens are not allowed to enjoy?
Personally I would prefer universal civil disobedience and rely on the common sense of the (non tribal rational) citizenry and jury nullification as a reply to unconstitutional court orders at any level!
Last time I looked the “KELO” Decision gave the “STATE” authority to Take Property through eminent domain for “Economic Gain”. SEIZE the Judges Home trough Eminent Domain, force the scumbag to take 50 cents on the dollar and use the proceeds to pay for this it’s?? surgery. ALL NICE AND LEGAL according to the USSC!!
Message to the DOJ: Give transgendered inmates some ointment, and shut the hell up.
Live by the rules, earn a living, pay a ransom for minimal medical coverage, while you pay taxes to subsidize those who don’t.
Contrast that with being a sexually confused felon with a long-term (or even life-long) prison sentence. Need a sex change operation (which is definitely OPTIONAL surgery)? How much does it cost? Doesn’t matter—no limit because you’re on the public protected class tab.
I would also bet that this is part of the LGBTQ agenda—start with “compassionate” care of the transgendered sort for prisoners, and then extend it to the non-imprisoned as an exception/over-ride to any policy restrictions.
