Coloradans become first to ask feds to block legalized marijuana

DENVER — Colorado already is being sued by two neighboring states for legalizing marijuana. Now, the state faces groundbreaking lawsuits from its own residents, who are asking a federal judge to order the new recreational industry to close.

The owners of a mountain hotel and a southern Colorado horse farm argue in a pair of lawsuits filed Thursday in U.S. District Court in Denver that the 2012 marijuana-legalization measure has hurt their property and that the marijuana industry is stinky and attracts unsavory visitors.

Living in CO I have mixed feelings about this, I don’t smoke anything, but I would like to see parity in smoking laws in areas like boulder where it is illegal to smoke tobacco in certain areas, but legal to toke up....

Basically I want to stick it to the hippies.

A reminder...

Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Most all are “Liberal-Tard-ians”.

They claim to be Libertarians, but are only “Social Liberals” who still want gruebermint goodies and don;t understand any sort of sepration of powers between city/state/federal levels.

Now, the state faces groundbreaking lawsuits from its own residents, who are asking a federal judge to order the new recreational industry to close.

What a terrible thing to do: further cement the idea that federal government is superior to the States in all matters … if you ascribe to that then there is no 9th and 10th Amendment and, moreover, you implicitly agree with the interpretation of the Constitution that allows the NSA's domestic espionage, the BATFE's regulation of firearms, and the imposition of same-sex marriage upon the States.

It's one way or the other: you cannot have the Federal government be superior only when it conveniently lines up with your personal philosophies.

a bedrock principle of the United States Constitution that federal law is the supreme law of the land

Perhaps someone could acquaint the "attorney" with the 10th Amendment.

Unless there is some interstate commerce involved, anything produced and consumed in Colorado is...Colorado's problem.

That may upset people...like the horse people....but it's the Constitution.

PS: Might just be me, but I'll bet if you were to go to the Horsey Farm, you'd find more then a few employees who are currently in violation of real Federal laws, like being in the country illegally, working illegally, etc....

Glass houses and all that.

Be that as it may, do you agree that CO, rather than fedgov, should regulate intrastate marijuana per the Tenth Amendment?

They already have/do — the NFA and GCA are shining examples of this.
(What's interesting is the reaction you get from certain conservatives when you assert that the GCA is unconstitutional because its prohibited persons sections makes it an ex post facto law and therefore the prohibition against [ex-]felons owning firearms is indefensible.)
