Judge: Clerks have duty to issue same-sex marriage licenses (FL)

A federal judge says that Florida’s county court clerks have a legal duty to issue marriage licenses to same-sex couples, but he has stopped short of ordering them to do so.

U.S. District Judge Robert Hinkle issued a ruling Thursday in Tallahassee federal court responding to requests to clarify his previous order that Florida’s same-sex marriage ban was unconstitutional. He stayed that order, but the stay is scheduled to expire at the end of the day Monday.

The association representing county clerks said the ruling applies only to Washington County, where a lawsuit filed by two men became a key basis for Hinkle’s order. Gay rights groups said Hinkle’s order applies statewide. …

Attorney General Pam Bondi’s Statement Regarding Judge Hinkle’s Order

TALLAHASSEE, Fla—Following significant public confusion about the federal-court injunction, the court today granted the clerk of court’s request for clarification. In the order, the court specified that the injunction does not require a clerk to issue licenses to same-sex couples other than the plaintiffs, but the court stated that “a clerk of court may follow the ruling, even for marriage-license applicants who are not parties to this case.” Attorney General Bondi’s statement is as follows:

“This office has sought to minimize confusion and uncertainty, and we are glad the Court has provided additional guidance. My office will not stand in the way as clerks of court determine how to proceed.”

Congress hasn't even fulfilled its obvious duty to impeach the traitor in the White House and his thugs.

One is starting to wonder if Congress is even constitutionally toilet-trained.

If he REALLY thought they had a legal duty, he would have ordered them to do so. He knows they do not. He just hopes to intimidate them into action so he won’t have to take the blame.

The Feds would not hesitate to sent federal troops to enforce a court order.

In Little Rock state officials were actively blocking students from schools and they had to be escorted in by troops. What actions would federal troops take against clerks who simply refuse to issue a license? Would they shoot them?

Under what legal authority would they do so? What statute authorizes such an action?

As you know, it is unlikely that judges who have no regard for the limitations of their own rights will have any regard for the extent of yours.

Judges have a great deal of latitude in enforcing orders of the court. Statute doesn't necessarily matter.

Here, the federal judges would simply appoint masters with arrest powers to supervise the clerks. The enforcement arm would be federal marshals functioning under court order.
