Courts Overloaded with Deportation Cases for Child Illegals

One year after the surge began of illegal migrant children across the southern U.S. border, courts are buckling under the load of deportation cases, while immigration rights activists are sounding the alarm that many children can't get fair hearings because they are without legal representation.

According to data obtained by Politico, courts convened over 800 hearings per week between July and October. More than half the 11,392 cases on the calendar during that time were given continuances because children had no legal counsel, adding to the backlog for courts in the coming months and increasing the burden on the limited network of nonprofits and pro bono attorneys working on the cases.

"We are totally under stress… We are at the point of implosion," Dana Leigh Marks, an immigration judge in San Francisco and president of the National Association of Immigration Judges, told Politico.

Courts are involved?  Why?

These are illegal immigrants.  They can point to family here and prove they are here legally, or back they go.

I don’t see the point in more than a few minutes per case. US citizens have a right to a lawyer provided at government expense in a criminal trial. If they are not citizens, they have no such right. Ask them a few questions in their home language, and send them home after 3 minutes in the 99% of cases with no valid claim to asylum. The remaining cases, in which the “child” claims a valid justification should receive a more detailed hearing, with a court-appointed attorney, and a lie detector.

There should be no release while awaiting trial, and there should be no coaching on “proper” answers by a dishonest lawyer. As for those who enter our country illegally, whether children or adults, they should be fingerprinted, DBA swabbed, and banned for life from any legal reentry and from any path to citizenship. Let’s make crime less profitable and more costly.

This is so easy to deal with. Start billing the country of origin for the legal bills. Deport any that their government won’t fund. They are not American citizens. We should not be paying their legal bills. THey should also bill the countries of origin for their room and board.

If you’ve already caught them enough to give them a hearing notice, you’ve caught them enough to deport them. Why would anyone illegal be allowed to run free in our country at all?

(in an ideal world of course. I’d be all in favor of executing them as they come across the border. Put some good old boys down there with no bag limit)
