You make a good point, however, the GOPe WILL have to deal with the conservatives who may or may not vote for their liberal legislation. I see taking the Senate as a win. If nothing else, it could hamper Obambi's continued destruction of our country.

Remember, Reid changed the Senate rules to a simple majority in some cases. If our go along to get along realize and don't adhere to ththose rules, their lifetime jobs are dicey. Again, it could be a win against Obambi. Keep the faith. I think the Country is ready for "Hope and Change" back to what worked.

Just wait until January 1st, 2015. That's when the real pain will kick in regarding business to comply with ObambiCommieCare. You think the last 2 years of reducing employees to part-time and cancelling their insurance plans were just anomalies? Hold on American workers and "gimmes" because the crap is going to hit the fan. I know because I owned 3 small companies, all with health plans.

I'm going to be laughing at everyone who thought Pelosi, Reid, and Obambi thought this to be a good idea without even reading the fine print. Yes, I know "single payer" was always the plan, but I would bet 3 to 1 that America will want to repeal this awful decision by USSC Roberts about it being a tax, even though the legislation said a "fine". Still can't believe that fu*cker made that decision.

Personally, I'm thinking there will be clinics springing up everywhere on each side of our borders. I hope they go public, because I would buy their stock. Just watch. Americans do what's best for themselves, "gimmes" not withstanding. Even they will say, "WTF"? "Gee, I thought it was free like my ObambiPhone". I probably will need a respirator to keep oxygen in my lungs from laughing so hard!

The gimmes are going to receive a real wakeup call soon when the Chinese start reigning in their loans and the administration looks at the dismal payments made into the IRS because they put so many people out of work or into part-time jobs because of Obamacare and killed the economy so bad that all small businesses earnings are way down. Now that’s when WE will get the last laugh...

Spot on assessment! Cruz will be kept far away from any position of influence or power if the Republicans take control of the senate. For one thing he embarrasses them, he calls the GOPE squishes out on important issues and makes them votes when it counts and that is the last thing a liberal wants to do, show their true colors. For this alone he will be fought tooth and nail far worse than anyway the GOPE would ever battle a democrat.

The SCOTUS is described in the constitution, but all other federal judges, and the law, and how they apply the law, are left up to congress.

It was only in 1810, with the Marbury v. Madison decision, that the SCOTUS decided it could rule laws as unconstitutional.

But the one way in which congress could impact the SCOTUS relatively quickly, is by enlarging it. FDR threatened to do so when the SCOTUS rejected much of his early New Deal. Importantly, such an enlargement is properly done by saying that the *next* president can appoint two more justices, for example.

There is one structural adjustment that is obvious. There are currently 13 courts of appeal, 11 for the states, one for D.C., and one for the Federal Circuit, created in 1984.

However, the 9th circuit needs to be split in half, and the other need some demographic rearrangement.

Behind the scenes, it would be a great opportunity to retire a bunch of the worst of the federal judges.

We can hope. But I see a McConnell Senate as more of a speed bump than an impediment.

Remember, Reid changed the Senate rules to a simple majority in some cases

Only for presidential appointments except for Supreme Court. Everything else can be filibustered. And the Democrats will.
