School District on Long Island Is Told It Must Teach Immigrants

Responding to complaints from dozens of Hispanic children who said they had been barred from public school classes on Long Island, the state on Friday issued new legal guidance regarding enrollment procedures, exhorting school districts to comply with federal law by allowing undocumented immigrant children to begin classes.

The students, many of whom are newly arrived immigrants, say they successfully enrolled in the summer or early fall, but were warned by Hempstead administrators that there was not enough space or teachers to accommodate them.

Diana Hernandez, 16, who came to Hempstead from Honduras in July, said in an interview on Friday that school administrators had asked her to come to school twice a week, on Mondays and Wednesdays. Diana says she signs in and then sits in a library for a few hours until an administrator sends her home, where she waits for her mother to return from work.

“I feel bored and alone,” Ms. Hernandez said.

The legal guidance issued by the state on Friday reaffirmed previous instructions that schools use wide latitude to enroll undocumented children. If they cannot supply documents proving residency because they are living with distant family members, for example, the state recommended that schools consider classifying the children as homeless, which under federal law allows them to attend school even without proof of residency.

I’ve been looking for the passage in the constitution that explains how federal law always trumps state and local law. I haven’t found it yet.

Legal guidance issued by the state reaffirmed using wide latitude to enroll undocumented children---whose parents were waiting til they got across to join them. The state says if the invaders cannot supply documents proving residency, the state recommended that schools falsify official documents---classifying them as homeless, which under federal law allows them to attend school even without proof of residency.

Falsifying Official Documents involves altering, changing, or modifying a document for the purpose of deception.......can also involve forgery and/or passing copies of false documents.

Falsifying documents is usually done in connection with broader criminal aims, such as extortion, government fraud, tax evasion, obtaining govt benefits, money laundering, financing terrorism........

Types of documents commonly falsified may include:
◾Tax returns and income statements
◾Personal checks
◾Bank account records
◾Business record keeping books
◾Immigration documents (such as visas, passports, etc.)
◾Identification cards and birth certificates

Many different types of acts can be considered as falsifying a document, including:
◾Altering or misrepresenting factual information such as prices or monetary amounts
◾Stating false information when requested to provide truthful statements
◾Forging a signature
◾Using official letterheads without authorization
◾Concealing assets or property WRT obtaining federal/state grants))
◾Knowingly using or distributing a fake document

A person can only be held criminally liable if they are deliberately acting with the intention of deceiving or defrauding another party.

Falsifying documents is a very serious offense and is generally classified as a felony. This means that a person charged with falsifying documents may be subject to the following legal penalties:
◾Having to pay a monetary fine
◾Incarceration in a prison facility

Depending on the gravity of the offense, as well as individual state laws, falsifying documents can result in a prison sentence of 5-10 years. Also, if government documents or authorities were involved, the legal penalties may be more severe. ..... legal penalties may increase with repeat offenses.

The penalty for falsifying government documents is outlined in the Crimes Act of 1958.

The feds allow them into our schools with little or no medical screening. Something an American citizen would never get away with at public schools.

These invaders are spreading Enterovirus and other diseases. Enterovirus is deadly and there is no vaccination. It has already infected and killed far more than Ebola in the US and most of the victims are children.

The acts of our Government have turned from politically motivated to absolute criminal.

They won't connect the dots. They are so mentally detached from reality they will never figure it out. Most will blame Bush, Republicans, the Tea party, Big Oil, Big Pharma and on and on.

Property taxes?

I know of one neighborhood where taxes run about $30 thou annually

New Yorkers just take it. They don’t know how beaten they are

They go through manhattan waiting to get hit again. Walk up the steps from the train at grand central with the disembarking passengers. You can hear a whisper

New Yorkers will defend Obama to this day. And the ones who watch fox or listen to rush live in secrecy for it. I am serious

Everyone in every house is so busy. The wives and mothers are all working to pay to live there. No one is home paying attention. But they’ll protect their birth control as one of the sole purposes of life

Get rid of that and you’ll have normalcy again

Flyovers don’t even get that concept

But the whole region all those states up there even NY went for Reagan in 1980

Birth control and abortion. These people won’t let it go. Not to ease up on tens of thousands in taxes annually

The village of Hempstead on Long Island is primarily a blighted town of black and hispanic residents, most of whom live on the edge. No other district on the Island would put up with this. I would think that Hempstead is receiving quite a bit of state aid to put these children in school. I volunteer at a Museum village on Long Island and recently a number of 1st and 2nd grade students from this district visited. They had an interpreter with them because 80% of the children spoke no English at all.

$30K? I’m guessing that is East or West Hampton on LI. In any case, that is just nuts.

Personal story: Back in 2004, I was thinking about taking a job in Rochester, NY. It seemed like you got a really good house for the $$, until I looked at the property taxes....$10K per year. No thanks—I didn’t need a second mortgage that couldn’t be discharged. But, 10 years later, my property taxes are creeping into that territory too (about 2/3 of the way there).
