Right, and you make a good point. But I also think it's important to see a significant difference. The side with the just cause is different now than then and could mean the difference between winning and losing.
Well, if the three branches, two elected (Congress & POTUS) and one appointed (SCOTUS), of the federal government would police themselves and each other regarding constitutionality, then the states would not have to.
But that not being the case, the states and the people must take the Constitution as our own and enforce it ourselves.
Amend the US constitution.
leave the homosexuals in fake marriage the way common law marriage was left to eventually die out when it was outlawed in the super majority of states.
