Thousands of undocumented immigrants arrested in the city each year would no longer be turned over the feds under a law proposed Thursday by City Council Speaker Melissa Mark-Viverito.
The bill would shield all immigrants who are picked up on low-level charges and are being sought by immigration authorities because they are in the U.S. illegally.
That represents a major change from current policy, which is to honor most detention requests by the feds. In such cases, agents take the detainees into custody for possible deportation.
Mark-Viverito’s proposal also calls for closing the office used by U.S. Immigration and Customs Enforcement, known as ICE, at the jail complex on Rikers Island.
“By further limiting ICE’s role in the detention and deportation of immigrant New Yorkers, we set the national standard for the treatment of our immigrant population,” Mark-Viverito (D-Manhattan) said.
“Families will no longer be needlessly torn apart by ICE’s dragnet enforcement efforts.”
Under the proposed law, the NYPD and Department of Correction would honor detention requests only for people convicted of a “violent or serious crime,” and only if a judge has issued a federal warrant for the person in question.
Currently, the city complies with detention requests for people charged with felonies and certain misdemeanors without requiring a warrant or conviction.

There is nothing stopping ICE from parking a bus outside the detention center and interviewing people as they depart.
What difference would it make? They’d just turn them loose anyway.
I live here and didn’t know the Communists in city government were still turning any illegal alien over to anyone expect his case worker for more benefits.
