McALLEN, Texas (AP) -- A Border Patrol agent pursuing a group of immigrants in a wooded area near the Texas-Mexico border on Friday fired several shots at an armed man who later identified himself as a militia member.
Border Patrol spokesman Omar Zamora said agents had been chasing a group of immigrants east of Brownsville Friday afternoon when an agent saw a man holding a gun near the Rio Grande. The agent fired four shots, but did not hit the man. The man then dropped his gun and identified himself as a member of a militia. Zamora said no other details were immediately available.
Cameron County Sheriff Omar Lucio, whose agency is involved in the investigation, said the incident occurred on private property and it appeared the man had permission to be there. He was not arrested, Lucio said.
The man, whose name has not been released, was wearing camouflage and carrying a long arm that was either a rifle or shotgun...

Why wasn't he arrested? This armed person fired on a citizen on private property doing nothing threatening or illegal.
So, BP can fire warning shots and get away with it?

That was my reaction. The BP agent just opened fire at the sight of a gun. No other cause.
Yes, I think so. American LEOs of all types need to get it straight, Americans can and do own guns and have the right and legal authority to use them when threatened.
That’s probably the BP’s new job mission— let in anyone who wants to come in. and shoot anyone who tries to stop people from coming in.
They can't shoot illegal mexicans, but Americans.................they can shoot all day!

Border Patrol agents are obviously not allowed to shoot at mexicans.
Just look back at the FR archives to read the news reports about not only enemy fire coming from the other side of the border aimed against the BP there, but the blatant flying of a mexican helicoptor with prominent markings overflying agents with total disregard of the illegality of the act since they had no jurisdiction on our side of the border and the BP agents doing nothing at all in response.
I will not publicly say what their responce SHOULD have been...

It’s legal to carry a long rifle in public in Texas. It sure as hell isn’t legal for a cop to shoot at someone just because he’s carrying a gun. Especially on private property.
I would wager that 90% of them are illegal (expired visas, or never had one). But that would be me.
Was the Border Agent arrested? Why not?

That is why good communication with BP and CSO is a MUST if you want to be part in securing our borders. These BP agents need to know who are in the woods. They are jumpy from putting their lives on the line everyday
The militia people need to be scanning BP freqs to know what they are doing so that they can either one, assist or two, get the hell out of the way. In this case, the militia fellow should have got the hell out of the way.
We used to carry the same garmin radio locators as BP with our positions on their locators. Worked sweet. I did not get shot. That is a plus in my book no matter which way you hang it. Plus we scanned their freqs on my radio and on main com operator so that we knew what was happening all the time. At night we wore IR strobes on our helmets for NVG work both boots and helo. Good communication both verbal and visible.
Don’t hide from them work with them and they will respect you more. If these guys are playing Rambo, then they need to GO home. They are going to create problems.
How do you get Catholic bashing out of any of the comments on this thread? Almost all of the illegals are Catholic, so is preventing them anti-Catholic?

I believe in the state of Texas, when deadly force is use against you, then you have the right to return deadly force, in almost any circumstance... I know it use to be that way..
The agent was probably there to run off the militia so they could run in some drugs or another bunch of illegals...
I wonder what the racial makeup of the border patrol is on the southern border...maybe 60 percent or more hispanic, some with family ties back in Mexico..?? I'll just bet corruption runs pretty deep....
After The obummer, Holder, the IRS thing, and others, I just know our own government, and a large percentage of it's agents, are working against us..!
