Judge sets Sept. 15 trial date for Mississippi election challenge of Chris McDaniel

JACKSON, Mississippi -- A trial is set to begin Sept. 15 for a lawsuit that seeks to undo a Republican runoff victory by Mississippi Sen. Thad Cochran.

Retired Chancellor Hollis McGehee, who's presiding over the case, filed a scheduling order Thursday in Jones County Circuit Court in Laurel. He specifies that the trial must be finished by Oct. 3. It will take place at the Jones County Courthouse.

No court is going to reverse the election and place him on the ballot. This is a waste of money. He needs to run as an independent or write in candidate if he has the popular support to win. Pull a Murkowski in reverse, that is the way to stick it to the treasonous GOP establishment.

Retired judges preside over trials as needed. I can’t give you a citation for the rules
but you can search the net and probably find some guidance. One advantage they
have is that they can devote their time to one thing without having to be spread
around over differing items.

Hey, a circuit court judge here in Florida is no deciding if he will, all by his little ole self..have our congressional elections delayed until next year..

Yesterday we learned that our election challenge is moving forward, and we’re very pleased to learn that Judge McGehee has a sense of both urgency and accuracy, and a strong commitment to the rule of law.

Here’s what we learned at the hearing:
Judge McGehee is moving forward quickly, and he wants to have this case decided before the November election.

He also indicated his authority to unseat Cochran if he were elected in November.

In another positive development, the judge communicated in a letter to circuit clerks that they should preserve the election records for the trial.

This is big news, and it is a clear sign the judge expects that evidence will be heard in court.
So, what does this mean for us?

It’s important to note that some in the media and Cochran’s camp are selling the canard that once the ballots are printed, that’s all she wrote. This is plainly false.

While the judge is trying to complete this trial in a timely manner as possible — and it would be most cost effective to reach a judgment prior to the printing of the ballots — the law is very clear that the challenge can continue even past the general election in November.

If the court rules in our favor after ballots have been printed, the ballots will be reprinted.

According to case law, if we are successful in this election challenge, Sen. Cochran could be required to vacate the seat even AFTER the November election.

... asked for an injunction to prevent Secretary of State Delbert Hosemann from printing ballots for the November general election,
where either Cochran or McDaniel will face Democratic former U.S. Rep. Travis Childers.
Tyner noted his request to hold off on ballots was partially political
but "politics do matter."

Cochran's lawyers argued, and McGehee agreed,
that Hosemann is not a party to the lawsuit
and cannot be forced to delay printing of ballots.
Sample ballots are scheduled to be delivered to counties Sept. 10,
and overseas military and others are supposed to be allowed to have absentee ballots starting Sept. 20.

But although state law urges expediency in a primary challenge, the court faces no hard deadline,
and could order a new primary even AFTER a general election is held.

[Special Judge Hollis McGehee] said he would send a message to county clerks
asking them to preserve voting records while the case is litigated.

McGehee plans, at least for now, to hear the case in Jones County, McDaniel's home area.
It will be a bench trial, with no jury.

Lara Van Overschelde, a McDaniel supporter and chair of the Mississippi TEA Party, watched the hearing Wednesday.
She said the case will be landmark for Mississippians.
"I think it is incredibly important
after what we've seen with irregularities in voting
and lack of real protocol and procedures statewide," Van Overshelde said. "

Yeah, them 'RATs NEED ALL THOSE First-Printed Ballots to corrupt the election !
Watch and see if there aren't MORE Ballots Counted in the General Election, than the number of people who sign the register on voting day, plus the number people who requested absentee ballots.

That trial should have already started.

Accepted. No sweat. Mississippi law blocks both your suggestions, however, his Dem opponent is as close to a blue dog as you can get in 2014. Pro-life and 2nd amend. In other words, a younger Cochran, less sleazy, with a different lapel pin.

No chance that I can vote for TC after what he did to me and my fellow patriots in Mississippi. NO CHANCE!
