Obama Administration Suing Pa. State Police Over Physical Fitness Tests

Saying that the physical fitness tests that the Pennsylvania state police uses to identify entry-level candidates are not job-related, the Department of Justice is suing the agency for sex discrimination since more men pass the tests than women.

“Through the use of these physical fitness tests, Defendants have engaged in a pattern or practice of employment discrimination against women in [Pennsylvania State Police's] selection process for entry-level trooper positions in violation of Title VII [of the Civil Rights Act of 1964],” reads the DOJ’s lawsuit.

At issue are the state agency’s 2003 and 2009 physical fitness tests that are one of eight criteria used to choose entry-level state troopers.

The 2003 test had five events — a 300-meter run, sit-ups, push-ups, a vertical jump, and a one-and-a-half mile run. To become an entry-level cadet, applicants had to pass each event.

Between 2003 and 2008, 94 percent of male test-takers and 71 percent of female test-takers passed all five events.

After a new test was implemented in 2009, pass rates rose for both groups. Ninety-eight percent of male test-takers and 72 percent of female test-takers passed the exam.

The DOJ claims that these results indicate discrimination.

In cases of discrimination, or disparate impact cases, “the 80 percent rule” is used as a benchmark to determine whether discrimination exists. The Pennsylvania state police’s results fail to pass this threshold, the DOJ argues.

In its lawsuit, the federal agency claims that if female applicants had passed the physical tests at the same rate as male applicants, “119 additional women would have been available for further consideration for the position of entry-level trooper.”

I remember a truck driver was carjacked in PA and driven into NJ (by Newark airport), where he was killed. The perps, who were caught shortly afterwards, had disarmed a female cop in PA and stolen her car. Upon crashing it, they carjacked the truck when the unsuspecting trucker pulled over to assist what he thought was a cop who had been in an accident.

Nowadays there is enough footage of female cops getting knocked out with one punch to justify real physical standards...

Lower the standards of everything. Now to mention it why do we even have standards? Just hire illegals to work as police officers. Hell they’ll work cheap and they can fire a gun. Sure why not? All those gang tattles and past criminal history; they won’t have any bearing on how they will perform their job or how they conduct themselves. Nah. Not in Obama’s Lalaland.

Obviously, both Obama and Holder are partial to the spirit of affirmative action, where a selection process for a small group established for a specific purpose/responsibility is not made on merit or ability but on some extraneous aspect of gender, race, sexual orientation, etc.

Discrimination?? Baloney 71% could pass it. It's not like it was 10% and an unreachable goal.

I think that Pa is one of those states that could go Repub. one of these days.

I thought PA would go Repub. for the last five elections without any luck. Now I am in SC and no longer worried that voters from Pittsburgh and Philly would cancel my vote. PA is lost, I fear, and a Dem. will be elected as governor this year.

I lived in Moon township, out by the Pittsburgh airport. Good people in PA but they are a blue state now and forever I fear.

Nowhere in the article does it state HOW or why the various physical requirements are not job related. Running, jumping and being physically fit ARE job related. I note that physical strength is not mentioned as a requirement obviously because it would eliminate 90% of women candidates. Isnt strength important to cops?
In reality this has nothing to do with job related requirements, it is just a way to get more jobs for minorities and women at the expense of actually qualified white men. BTW isnt it interesting that to do that always requires that standards always have to be LOWERED?

Maybe the PA State Police dont' want this riding around on their interstates...

State Police - as all police - should have standards that make it HARD to get in - and continue to push for PT standards so cops relive stress through workout...

Doctor tests are not fare.
