DENVER — The attorney for Anthony Waller, the shackled inmate who was seen on surveillance cameras being slammed into a wall by a Denver Sheriff’s deputy during a hearing before a judge in 2012, has filed a lawsuit over the incident.
The lawsuit in U.S. District Court names the city and county of Denver, Deputy Brad Lovingier, Capt. Gina McCall and the Denver Sheriff’s Department.
A news release sent by attorney Kenneth Padilla on Wednesday says Waller was “shackled in handcuffs, leg irons, and belly chain” when Lovingier “without provocation, grabbed Mr. Waller by his shackles, spun him around and violently slammed him into a large glass window and metal post. Waller collapsed onto the ground, sustaining serious injury.”

Judge Doris Burd filed an internal affairs complaint with the Denver County Sheriff, but the Denver District Attorney’s office declined to prosecute the deputy. Lovingier was suspended 30 days and according to his disciplinary case file, a witness called the deputy’s actions “a little excessive.”

Lovingier, a 12-year veteran of the department and the son of former Sheriff William Lovingier, appealed the suspension, but it was upheld by the Career Service Board.

There was a guy in CA yesterday sentenced to 10 years in Prison for throwing a chair at a Deputy in Court, I’m sure the DA will ask for the same in this case right??

DA already declined to prosecute, even though the judge filed a complaint. Wouldn’t upset me in the least to see the jack boot and DA swinging from a lamp post.

Which is why I have always said that whenever a Public Servant is Accused of committing a “Criminal Act” it should be Investigated and Prosecuted by “Officers of The Court” who are Criminal Defense Attorneys. True Adversaries.

I would think a complaint FROM A JUDGE would be an automatic rule for prosecuting a cop. Is the DA acting like a judge?

While I understand most arrests are made for cause, in this country we have the principle of innocent until proven guilty... The crime, after it is established beyond a reasonable doubt by a jury, then has a judge issue a sentence in accordance with established law.
It is not up to a deputy, police officer or any other government agent to meet out justice or punishment on their own.
Suppose at some future date, when being a conservative or Christian becomes illegal, some atheist deputy decides he needs to throw your God-believing butt into a wall? Would you like that?
Whether he is as innocent as you silly post states, or a despicable scumbag, has no bearing on the behavior of his guards.

If one knows the Denver court system, having a judge recommend prosecution is double damning.
