Texas Attorney General Greg Abbott filed an appeal with the U.S. 5th Circuit Monday regarding the state’s same-sex marriage ban, which was ruled unconstitutional by a federal judge in February.

Although I agree with his definition of marriage, these days, almost every judge will come out against Traditional Marriage and in support for Gay Marriage. Until certain key justices are replaced over the next 10, 20 years, this will not change. Recall, that only recently, have we as a society become slightly tilted in favor of pro-life laws, vs having everything only support the pro-abortion lobby. This societal change took over 30 years to build up steam, mainly because a lot of the old guard pro-abortion judges are retiring or passing on.

And what makes you think that could possibly happen? The issue has gone in just a few years from public opinion strongly against to public opinion slightly in favor at the moment. All movement is in the direction of pro-gay marriage, and the rate of change is increasing steadily. There is absolutely no reason to expect that to change.

Let's face it. We have lost this one. Until there is a truly drastic change in American society, that won't change.

Abbott’s argument is clear and solid and will not lose at the 5th Circuit or even at the SCOTUS as everyone knows that only opposite-sex marriage can produce children and gay marriages cannot produce children.

And that should be all that really matters. The people take a vote, pass an amendment to the state constitution and the US Constitution’s 14th Amendment with due process and equal protection must take a back seat to the voters of a state.

More than any other issue, I think the judiciary motivates me to vote. A president is gone in a term or two, but a judicial appointee is there for decades.

There is no ban, per se, but an absence of a legal recognition of a homosexual union as a marriage. If something is banned, there is usually a penalty for violating the ban.

When will some governor grow a set and say something like this:

"Having consulted with our state's Supreme Court and Attorney General, my finding is that no judge or panel of judges can supercede an amendment to our state constitution. Therefore, I declare this decision to be null and void in the State of *******. No same sex marriage will be performed or recognized in our state without exception."

You may have arrived upon the answer. States such as Texas should institute an actual ban on gay marriage and prosecute those who get gay married in another state and prosecute all those who act in a manner that facilitates the act or continued status of a gay marriage.

The problem is with all the federal purse strings and that is a powerful extortion device.

Until states are prepared to go it alone, they won’t have the guts to defy the federal government. Perhaps secession really IS in order?

You are right in that the menacing federal government would not hesitate to send send in troops to enforce unjust federal laws that violate the standards of the majority of the people in conservative states.

Lincoln went to war, Eisenhower sent in troops. Obama would do the same to impose his will on conservative states.

Bullsh*t. Not when the people have a voice. A grand total of 2 states have voted queer “marriage” into law.

Activist judges are what’s wrong with this country.

Sorry, I wish you were right, but you just aren’t.

Since 1996 the percentage of people in favor of gay marriage has gone from 27% to 55%, and there is no sign of this change slowing down. It is probable that within a few years the antis will be down to the marginalizing 27% the pros had 18 years ago.

2 states have voted queer “marriage” into law. In Washington State Bill Gates bought and paid for it. Pro queer forces outspent (think Gates), real marriage forces by 10-1 and still barely carried the day. Two years ago NC overwhelmingly voted real marriage into the State Consitution. You can believe these left-leaning polls all you want, but when the people get a chance to be heard it’s usually voted down. Even in California, where they have voted it down TWICE, only to be usurped by a homosexual activist federal judge!

I am not a fan of gay marriage or judges imposing their social engineering on the rest of us. But that’s not the real issue here.

Maine, Maryland and Washington voters approved gay marriage in the 2012 election. These were the first states to do so. All previous such referenda failed. All those on the ballot in 2012 passed.

Since then several more states have passed laws via the legislature approving it. 21 states and DC now have approved it, by referendum, statute or judicial decision.

This is not, at this point, a case of activist judges imposing their preferences on the rest of us. The public opinion has changed and continues to change.

IOW, it’s a bandwagon going the wrong way. That I believe they’re going the wrong way does not change the fact that most people will jump onto a bandwagon, no matter what direction it’s going.

Personally, I’ll be surprised if any referendum against gay marriage passes in the future, with possible exception of the most conservative states.

IOW, you were absolutely correct five years ago. Now you’re not.

BTW, this massive and incredibly rapid shift in public opinion shows just how important the media and entertainment is in politics. This shift occurred as the result of a 20 year or more campaign in the culture to make homosexuality lovable and cool.

It worked, mostly because you can’t fight something with nothing. Conservatives abandoned the culture to “progressives” some decades ago. We are now seeing the results.

As the great Breitbart said, politics is downstream of culture. Those who control culture today will control politics tomorrow.
