The Ordeal of Shaneen Allen [Faces 10 years in jail in NJ for carrying legal concealed gun]

In October of 2013, a Pennsylvania resident named Shaneen Allen drove into New Jersey’s Atlantic County and was pulled over by police for an “unsafe lane change.” When the detaining officer arrived at her car window, Allen informed him that she was carrying a concealed firearm, and presented her Pennsylvania carry license as proof of eligibility.

Unbeknownst to her at the time, however, was that New Jersey is among the 20 states that do not recognize Pennsylvania’s permit. In consequence, she was arrested. If convicted of the charges that the state has elected to bring, she will be locked in prison for up to a decade.

A single mother of two young children, Allen works more than one job and as a result leaves her home at odd times of the day. After two robberies made her aware of her vulnerability, she became convinced that she should be prepared to defend herself and her family, and resolved to do something about it. Which is to say that Allen bought her firearm, and obtained her concealed-carry permit, not to commit crimes but to prevent them. This has failed to move the prosecutor, Jim McClain, an overzealous man who has routinely declined to use the considerable latitude with which he has been entrusted by the state.

Based on this article, the prosecutor should be tarred and feathered and his body hung in public.

I thought states had to give “full faith and credit” to the documents of other states?

Well let’s face it, New Jersey has to do whatever is necessary to maintain its historically low murder rate.

Honestly, if you can’t find someone more dangerous than this walking the streets of New Jersey, you must be in another state.

I don’t think he can pardon before there’s a conviction.

But he could urge the prosecutor to lay off.

He won’t, IMHO.

That benighted state is populated mostly by left-wing, welfare-loving, anti-gun progs. Most gunnies know that, but it probably never occurred to her that by simply crossing a line she became a felon. Technically. Sad.

Historically, gun control laws were passed to keep freed slaves from exercising their right to keep and bear arms. It looks like the State of New Jersey is still at it.

He could pardon or commute the sentence, after conviction. Here’s one he commuted to time served.

This is misleading. The gun was not legal in NJ. Arguably it should have been, but that's one of the problems with federalism and states' rights, sometimes states do stupid or immoral things.

Some states are moving towards declaring that anyone who would make such a suggestion is mentally unqualified to have firearms and they will be confiscated.

That in itself is another form of Second Amendment nullification.

It's a good point that the article is wrong in saying the gun was legal, when it wasn't legal in NJ.

But as to justifyling New jersey's law, you are being to cavalier because what New Jersey is doing is stupid, immoral AND unconstitutional.

"the right of the people to keep and bear Arms, shall not be infringed". Just because courts have somehow twisted that to mean that they can be infringed doesn't make it right.
