I just hope this doesn’t put a damper on Obama’s 16 day Vineyard vacation. If it does, he may have to schedule an immediate 17 day HI vacation, to make up for it.

Hey, Nancy,

Judges are reading the bill that you and your colleagues were too lazy to read and those judges are not liking what they are finding in the bill.

Maybe you SHOULD have read it to find out what is in it.

Now we need to cut off the head and stuff the mouth with garlic. This thing needs to be permanently, totally killed.

I wonder how this was initially scored by the CBO? Did the Democrats ask the CBO to score the health care law based on all of the states setting up their own exchanges? This would be solid evidence that they wrote the law this way on purpose.

Ted Cruz just issued this statement:

“The D.C. Circuit’s decision today in Halbig v. Burwell is a repudiation of Obamacare and all the lawlessness that has come with it,” said Sen. Cruz. “The Obama Administration, through the Internal Revenue Service, has attempted to dispense revenues to the states without proper congressional authorization, robbing Congress of its constitutionally-provided power of the purse. This decision restores power to Congress and to the people and if properly enforced, should shield citizens from Obamacare’s insidious penalties, mandates, and subsidies. This is a significant victory for the American people and the rule of law, but we must not rest. Americans will continue to lose jobs, pay higher premiums, and receive fewer healthcare choices because of this disastrous law. Every last word of Obamacare must be repealed to restore jobs, growth, and opportunity in our country.”

It was a tower of abuse and fraud that should have been toppled long ago:

"Another Obamacare Success Story: HHS Says It Can’t Verify U.S. Citizenship Of 1.3 Million Enrollees"

... with probably just as many who succeeded to fraudulently verified their citizenship!

White House spokesman Josh Earnest said the ruling—for now—"does not have any practical impact" on premium subsidies issued to HealthCare.gov enrollees now."

"We are confident" that the ruling will be overturned, Earnest said. "We are confident in the legal position we have . . . the Department of Justice will litigate these claims through the federal court system."

Earnest said "it was obvious" that Congress intended subsidies, or tax credits, to be issued to Obamacare enrollees regardless of what kind of exchange they used to buy insurance.

While speaking out of both sides of his mouth simultaneously, Earnest appears to think this blob of ketchup flung on the ACA is going to brush away with a single flick, like a kernal of popcorn. He is wrong again.

“Update: Will it stand, though? Good point on procedural next steps here:

Reid’s nuclear option, which put 3 new Obama-appt judges on the DC Circuit, could save Obamacare.”

— Sahil Kapur (@sahilkapur) July 22, 2014

“Federal appeals courts typically assign three judges to hear a case. This one came out 2-1. The losing party can petition, though, for an “en banc” hearing, in which all judges on the circuit re-hear the case together and issue a new opinion affirming or reversing the previous one. Kapur’s point is that ramming through a few Obama appointees means this case has a better chance than it otherwise would have of being reversed en banc.”

“Update: The White House is already getting ready for en banc review:

Obama Adm official on Halbig: “The Department of Justice can, and will, seek en banc review by the full D.C. Circuit”

This decision has put me in position to be cheering that taxpayers in certain states will be paying more in taxes by attempting to follow the law by being forced to purchase insurance

Conflicting judgments from courts as cited on msn

A three-judge panel unanimously said the law was ambiguous, and that it would defer to the IRS’s determination that subsidies could go to individuals who purchased health insurance on both federal and state-run exchanges.

A separate panel from a federal appeals court in Washington on Tuesday morning said the IRS could not offer premium tax credits to people who purchase insurance through the federal insurance marketplace that serves most of the 8 million consumers who have signed up for private coverage for 2014.

obamacare is like the evil villain in a hrorror movie.

I won’t believe it’s dead until its been dismemembered, stomped, beheaded, driven over, and lit on fire. And even then its probably not dead. But one can always hope.
