Cyclist Arrested For Videotaping Cop During Red Light Stop
The Gothamist ^ | May 2, 2014 | Ben Yakas

Photographing and videotaping anything in public view—including federal buildings and the police—is legal in NYC as long as the documentation does not impede any law enforcement activity. Nevertheless, plenty of people—including journalists—continue to be arrested and harassed by camera-shy NYPD officers.

- snip -

While in the back of the car, Paybarah (the arrestee) says he asked the officers why he was arrested for taking video. One officer responded memorably:

I was told by another officer while in the car that recording a police officer was illegal because people are using iPhones as guns and shooting cops through the camera lens.

Someone needs to take this issue to the Supreme Court. It's a free country...

Public space can be photographed - it's why newspapers can take pictures in the public square and NOT be worried about getting signed ‘permission’ from the people being photographed.

It's part of living in a free society.

Control freak cops ( and yes there are some bad apples in any group) - thugs at Homeland Security - and all the myriad SWAT teams run by every federal agency need to understand they function within a free society... The United States is NOT a totalitarians State...yet. And if free loving people have their way, it'll never be a totalitarian state. My suggestion to cops who don't want to be caught on tape doing something illegal is DON'T DO ANYTHING ILLEGAL to start with...

“recording a police officer was illegal because people are using iPhones as guns and shooting cops through the camera”

Me:
“Officer, why would you repeat such a ridiculous story as an excuse to arrest me?”

“Perhaps if you did your job right, you wouldn’t worry about being recorded?”

“Officer, what you really need to be concerned about is that this video is being transmitted to a remote location.”

Lots of pinhole spy cameras out there to buy.

Yeah, but I haven't found any of good enough quality yet.

From a local paper in eastern Washington:

http://www.dailysunnews.com/news/2014/may/02/librarian-nets-8000-settlement-sside/

This city has only 26 -30 officers but has shot 3 people in the last 3 years and numerous dogs!

Here’s an example of proper use of cell phones by the brave men in blue:

From the article:

"I was told by another officer while in the car that recording a police officer was illegal because people are using iPhones as guns and shooting cops through the camera lens...I told him that I have the right to be recording a cop and he said that there were incidents, specifically in uptown Manhattan where a kid shot a cop with his iPhone. Straight face. Very serious."

This imbecile is the product of today's "education system". Just imagine what numbskulls will emerge from the "Common Corps" abortion...

The latest iPhone is 0.30 inches front-to-back (along the lens axis), and the thickest current model is 0.37 inches thick.

(For scale, the bore diameter of that "dummCOPf's" [sic] issue 9mm weapon is within the high end of this range.)

Just how much barrel length (much less cartridge case and bullet length) does this NYPD affirmative action genius think would fit crosswise in his 9mm barrel?

Talk about abject ignorance of physics and simple reality...!!!

~~~~~~~~~~
(Re "affirmative action genius": does anyone seriously believe that this moron made a passing score on the NYPD entrance qualification exam -- or the exit exam from police academy?)
G_d save us from what our "education" system is doing to present and future generations! (And the incompetence liberal "diversity" is forcing on all our public institutions!!)
Ha!
I’m a 1971 KHS grad, so I’m not surprised by goings on in Pasco.
71 was last year for Kennewick only Seniors.
Kamiakin’s first grad’s were 72.
Lived off and on in the Tri Cities since 78 myself.
The Pasco cop Orate was a former Sunnyside cop and when all of this was going down was trying to get back on with Sunnyside but fortunately the City Manager said no to the acting Chief who was well aware of him being under investigation.
Got to protect the brotherhood at all costs!
So where does that leave us? Should cops be allowed to treat every cell phone as a potential firearm? And I suppose you could easily convert an umbrella into a single shot shotgun. So how should cops treat umbrellas?
Three things:
1) A cell gun shoots along the long edge. A cell phone being used for video recording is facing you with the long edge at right angles to you.
2) A cell phone gun is non functional as a cell phone. If it's ON, it proves it can't be a gun, and the cop should just go away.
3) The cell gun in the video used one of the old LARGE cell cases to house it. A modern iPhone is too slim to fit a gun into.
Cops suggesting using a cell camera could be a threat to them because it could be a gun is an asinine ridicules argument.
If that were the case, every time someone pulled a wallet to show ID, they'd would be shot on the spot or arrested.
