MILITIA TO BLM: ‘WE ARE PREPARED TO USE DEADLY FORCE’
Breitbart ^ | April 24, 2014 | By Bob Price

Posted on 04/25/2014 2:43:35 PM PDT by Jim Robinson

One of the militia groups who joined the effort to “protect” the Bundy family and their ranch from the armed Bureau of Land Management (BLM) rangers admitted they are prepared to use deadly force in self-defense in Nevada or Texas. Several militia groups have joined ranks to provide “protection” to keep the BLM from taking property from the Bundy Ranch, most of which operates on federally owned land.

Scott Shaw, co-founder of the Oklahoma Volunteer Militia says he is just an average American who goes to work every day and pays his taxes. He described his militia members as “every-day citizens ...We just have a strong conviction for freedom and liberty and upholding the Constitution. We are just here in case our court system fails us and we have to stand up to the federal government.”

In talking about the armed force of BLM rangers, Shaw described it as questionable. “If you’re there to get your money back that [Cliven Bundy] allegedly owes you, there are several ways you can do that in a court of law. You can put a lien on his property; you can put a lien on his cattle. If it truly was about getting back the back fees, why did [the BLM] take the cattle, or round the cattle up, which are the asset you’re going to sell--why would you kill several of those?” Recent reports revealed several cattle that were killed allegedly by the BLM during the standoff earlier this month.

Shaw affirmed that his militia members who deployed to Nevada were armed with a variety of military style weapons including AR-15s, AK-47s and others. They also include precision shooting firearms like deer hunting rifles and other military surplus items...

I believe Adams was warning against using the 2nd Amendment to foment anarchy. I agree with him.

The Resolution of 1780, “the federal trust respecting public lands obligated the united States to extinguish both their governmental jurisdiction and their title to land that achieved statehood.”

In the Constitutional Convention of 1787, The Charter of Liberty contained these words, “The new Federal Government is an agent serving the states.”, “The delegated powers are few and defined”, “All powers not listed are retained by the states or the people”, “The Resolution of 1780 formed the basis upon which Congress was required to dispose of territorial and public lands”, “All laws shall be made by the Congress of the United States”. (not agency bureaucrats!)

That should be sufficient for you to determine who all public lands belong to, hint - NOT the Federal Government!

Articles of Confederation, Article VI, clause 1 All engagements entered into before the adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation. In Article IX “... no State shall be deprived of territory for the benefit of the United States.”

Beck and Hannity both sort of put themselves out of the game yesterday. Both of the fools went off prematurely and sold Bundy down the "progressive river".

Today they both look like useful idiots as does Rand Paul.

All three of them deserve whatever happens to them for their cave to the left.

I've been real sick of the three of them for quite awhile.

0’Reilly and Bernie Goldberg piled on along with all the rest of them. Charles Krauthammer made a complete fool of himself in particular. On Special Report he condemned “Bundy’s words” and in the next hour on On The Record he made the exact same points while discussing the subject of the SCOTUS decision on Affirmative Action that Bundy had in his comments. No substantive difference whatsoever but Krauthammer said it in a Harvard dialect.

“2nd Amendment is working!”

Very good point.

This is why we have it.

In our country, we are blessed with the principle that martial power and the force of law are both under the authority of a duly-elected civilian authority.

Prior to the American Revolution, we had the Continental Congress *and* Committees of Safety -— Massachussetts had the first Committee of Safety, and that committee had command of the militia.

George Washington was *not* chosen by some “militia-like club” to be head of the forces around Boston in 1775; he was chosen by the Continental Congress.

Currently, there is no Continental Congress. There is no duly-elected Committee of Safety for the State of Nevada; and again, none for the county of the Bundy Ranch.

The county of the Bundy Ranch has also not let it be known, that its existing duly-elected commission is standing up in stead of the required Committee of Safety.

So, at the moment, there is no Constitutional civilian authority in charge of the assembly of armed men and some women ... re the situation at the Bundy Ranch; except, that they may be adhering (we sure hope) to the authority of the county sheriff (in which case, they may be acting as deputies).

Or, what is developing there, is a Shays Rebellion that will be put down, including the loss of Arms of the participants *and* supporters ... and some of their property, too, given the current nationalizing-socialist police-state climate and thereof, much greater martial power.

On the chance that another confrontation occurs, what are the preparations by the armed assembly, in order to at least provide proper facilities and support in the event of some success?

What shall the rebels do, if they encounter numbers of wounded and/or captured of the national agencies that descend upon the place? To whom will they efficiently hand over the captives -— lawfully following the principle of due process -— and where will the dead and wounded be taken?

Without the support of the people of the county’s duly-elected civilian authority, and without the same of the State of Nevada, there will just be a lot of chaos, tragedy, and unhappiness, and improper detention of captives.

A stunning victory by the rebels, might gain a sudden self-realization among a majority of the people of Nevada, that they actually do want to stand up against the national government’s tyranny ... but figure the odds, and figure *that, before* somebody without civilian authority orders the rebels into action.

The rebels have apparently paid little attention to the basic necessity, that there be a duly-elected civilian authority with overall command over them.

By the way, they *are* rebels, unless they are acting as deputies for the moment, under the authority of the county sheriff.

They are not presently in the Nevada militia, because there is only 1 militia per state and 1 per territory and 1 per the District of Columbia (if it chooses) of our United States. The duty of our militia, is to their respective states, territories, and DC (again, if DC chooses).

The term, militia, is not the same as “the militias” of other countries; not exactly the same as once existed in England.

Because, in our country, we individually have the right to keep and bear Arms; but it is when mustered, we form military units of organization and potentially may exercise martial power. We have the right to drill and train ... but not to exercise martial power without the authority to act so, from our duly-elected civilian authority.

In that way, the people know they are safe, the militia are answerable to civilian authority, instead of “going off half-cocked.”

Our militia, are under the duly-elected civilian authority of each state (or territory), and they have a lot of responsibilities to the people of their respective commands.

The body of Armed men in Nevada at the Bundy Ranch, are *not* militia; rather, they are a gun club. They *could be* militia, but that only happens under the duly-elected authority of the citizens of Nevada, local or state.

Article 1 section reads in part:

To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings

I agree that the feds own too much land. However to correct the situation, we will need a Constitutional amendment as this is an enumerated power of Congress. I’d like to see the feds limited to 20% of a state’s land mass.

I think of idioms like `I swan!’ and of characters like young debutantes suffering from a case of the vapors at the cotillion when talk turns to things like shooting and getting shot at, especially when DU goos goos and others start commenting on self defense, defense of others and one’s country, and racism, `social justice’, etc. and apparently forget we’ve been getting shot-at in this country for almost 400 years.
So I preach when I can/often about the importance of body armor as well as BLOAT. (That probably set of some NSA sirens.)
To put things in perspective, todays wild-eyed, exploding terrorists pale some when compared to Apaches tying a white man to a wagon wheel and slowly roasting him to death over a low fire ... I swan! :-0

Sorry, the land in question belongs to the US government.

As to “The delegated powers are few and defined”, “All powers not listed are retained by the states or the people” yep, Article II section 2 Treaty clause - Treaty of Guadalupa Hidalgo transferred the lands in question to the US Government. Article 1 section 8 enumerates the specific power of Congress to have exclusive jurisdiction of US Government land.

When I had guns; I liked 7mm Rem mag. Best all around gun for the hunting I do here in the open country. 300 Win mag is very popular here also but most kick harder than I prefer.

Yep. It's what I (will) use.

Took 4 deer with it one year. one of the bucks turned right as I shot. The bullet went through the shoulder, through the body cavity, and through the right thigh...stoping right at the skin. Massive damage.
