Virginia to fight same-sex marriage ban (Atty Gen)

Virginia Attorney General Mark R. Herring will announce Thursday that he believes the state’s ban on same-sex marriage is unconstitutional and that Virginia will join two same-sex couples in asking a federal court to strike it down, according to an official close to the attorney general with knowledge about the decision.

The action will mark a stunning reversal in the state’s legal position on same-sex marriage and is a result of November elections in which Democrats swept the state’s top offices. Herring’s predecessor, Republican Ken Cuccinelli II, adamantly opposes gay marriage and had vowed to defend Virginia’s constitutional amendment banning such unions, which was passed in 2006 with the support of 57 percent of voters.

Herring, too, had voted against same-sex marriage eight years ago, when he was a state senator. But he has said that his views have changed since then and that on Thursday he will file a supportive brief in a lawsuit in Norfolk that challenges the state’s ban, said two people familiar with his plans.

Herring will say that Virginia has been on the “wrong side” of landmark legal battles involving school desegregation, interracial marriage and single-sex education at the Virginia Military Institute, one official said. He will make the case that the commonwealth should be on the “right side of the law and history” in the battle over same-sex marriage. . .

And how does the state attorney general justify this other than his own beliefs? His job is to defend the laws of the state, not his own preferences. This is cause for impeachment and/or recall.

If the judicial rulings in Utah and Oklahoma hold, its all over for marriage and for your freedom of religion, at least here in the USSA.

One must look at the new State Senator from Northern VA.

The R’s ‘split’ the vote but SHE (the LIB) won 53%.

However, for whatever a State Senator makes in salary, this lady, for what seems like a month, ran prime time ads on ALL the local TV stations, running at least 1 or possible 2 an hour from Jeopardy to the 11PM news at least 5 nights a week.

Brings a whole new light to saying someone spent 20 million dollars to get a 2 year job that pays 180(?) Thou per year (As in Congress).

I don’t know if it is still the law, but it used to be illegal in Virginia for two men to share an apartment. I have known plenty of straight men elsewhere to share an apartment.

This is another example of why the “living constitution” is such a fraud. This attorney general voted FOR the constitutional amendment just a few years ago. Now he thinks the state constitution is unconstitutional under the federal constitution. What changed? The living federal constitution.

A living constitution means whatever you want it to mean, which means it means nothing.

This is a violation of his oath of office, just 10 days into office, and an impeachable offense.

Actually, Northern Virginia and Hampton Roads elected the SOBs. . .and oddly enough, districts that routinely reported totals within an hour of the polls closing, reported 3-4 hours late this time. . . destroying the lead of the Conservatives.

Funny how that works. . .

it was totally predictable that it came down to Fairfax. I told my wife that they needed to figure out how many votes they needed to call in the mysterious car with a trunk filled with just enough ballots.

Now we’re stuck with a witch hunt that will ensnare Cuccinelli, and four years of the Governor and AG of the People’s Republic of NoVa telling the rest of the Commonwealth that gay marriage and gun registration will help lower unemployment and improve education.
