Wyoming to EPA: Place Tribal Boundary Decision on Hold and
Reconsider
CHEYENNE, Wyo. – In a petition to the Environmental Protection Agency (EPA) filed today, the State of Wyoming, through the Attorney General, says the EPA used incomplete facts and faulty legal conclusions when making its decision to change existing law and alter the boundary of the State and the Wind River Reservation (WRR). The State’s petition asks the agency to reconsider and also stay any implementation of its December decision revising the WRR boundary.
“I understand that the Northern Arapaho and Eastern Shoshone Tribes have a different opinion about the Wind River Reservation Boundary. My deep concern is about an administrative agency of the federal government altering a state’s boundary and going against over 100 years of history and law. This should be a concern to all citizens because, if the EPA can unilaterally take land away from a state, where will it stop?” Governor Matt Mead said. “I want to thank the Attorney General and his staff for acting with urgency and preparing a thorough review of the historical record. This analysis shows how flawed the EPA was in its legal justification for its decision. The federal government clearly had a predetermined outcome it sought to uphold.”

Not much info in the governor’s statement, that informs us of either position - the State of Wyoming or the EPA.
Also, *nothing* at the State of Wyoming’s Attorney General link (http://attorneygeneral.state.wy.us/) ... no “thorough review of the historical record” and no show of an analysis of “how flawed the EPA was in its legal justification for its decision.”

A rare spotted wing snot fly was reported to have been seen in the area. The sighting could not be confirmed but the EPA is seizing 1 million acres just in case.

What Constitutional authority does the EPA have to change ownership of any land, or to alter the boundaries of any political jurisdiction?
“If you alter a state’s borders, aren’t you creating a new state from the old one?”
Far worse is the placing of an entire town under the rule of an Indian Tribe.
As “Tribes” are considered ‘separate nations’, they have their own laws.
By placing that town under Indian rule, they are deporting American citizens to a stone aged legal system without due process.
EPA must not be allowed to strip Americans of their Constitutional Rights by a de facto deportation of them to a “separate nation” system where ‘tribalism’ & Stone Age law rules.
I don’t know how they justified establishing the Indian Reservations, but when does the indemnity we’re paying stop? There may have been good reasons for it at first but we’re long past the days of chasing buffalo up and down the plains on horseback.

I am aware of the above.
My post addressed the question of whether an American citizen can be de facto deported by an agency?
What of a LEO arresting an American and taking said American onto Indian land?
Legal via the usual “Memorandum of understanding” between agencies?
Or an illegal infringement of the arestee’s Constitution guaranteed rights?
