Utah man sentenced for crime committed on LDS mission in Chubbuck

POCATELLO — A Cedar City, Utah, man convicted of felony injury to a child stemming from inappropriate contact with a 16-year-old child in 2012, was placed on probation Monday and sentenced to spend the next 10 days in Bannock County Jail.

Derrick Starley was serving a mission for the Church of Jesus Christ of Latter-day Saints in Chubbuck when the incident occurred. He was originally charged with sexual battery of child 16 or 17 years old...

Starley pleaded guilty to the reduced charge in early November as part of a plea agreement through which prosecutors agreed that they would not oppose probation but also said they would likely ask for local jail time.

JaNiece Prices, assistant chief deputy prosecutor for Bannock County did just that. She said that based on the presentence investigation report and psycho-sexual evaluation, Starley did not appear to be a substantial risk to re-offend, but that he did need treatment for an addiction to pornography.

She asked Sixth District Judge Robert Naftz for local jail time and that the treatment be a part of Starley’s conditions for probation. She also recommended Starley’s probation be a lengthy term to assure he has time for that treatment.

The victim’s father then spoke to the judge, conveying the depth to which the incident has affected the victim and their family. He then said the family has forgiven Starley and only hopes that he gets the treatment he needs.

The judge sentenced Starley to serve 10 days in the Bannock County Jail in addition to the five days he spent in jail when first arrested, meaning he will spend Christmas in jail.

“You affected people by your conduct,” Naftz told Starley. “There has to be some kind of consequence so you understand.”

Just a minor nitpick... I think it is rather misleading to refer to a 16 year old as a “child”. We should expect 16 year olds to behave more as adults than children. A 16 year old is more like an 18 year old than like a child.

We should expect 16 year olds to behave more as adults than children. A 16 year old is more like an 18 year old than like a child.

And a thirteen year old is more like a sixteen year old ("adult", to you) than a ten year old. And so pedophilia is made reasonable in twisted minds.

Before painting the 16yo victim as the responsible adult here, how about a thought for the responsibility of the predator. Or are we changing the goalposts on what constitutes rape as well?

Ol' horndog Joe got away with messin' around with MUCH younger ones.


The most conservative estimates indicate that Joseph entered into plural marriages with 29–33 women, 7 of whom were under the age of 18.
The youngest was Helen Mar Kimball, daughter of LDS apostle Heber C. Kimball, who was 14. The rest were 16 (two) or 17 (three).
One wife (Maria Winchester) about which virtually nothing is known, was either 14 or 15.

Well, congrats! The world has educated you quite well! (And you've been their excellent learner!)

If I was teaching a class on how to spot and respond to cultural liberals, your comment here would be an excellent example for pinpointing subtle craftiness re: cultural liberalism.

What do I mean?

Well, to be "pro choice" is a fine thing in a free country; UNLESS, of course, we're talking about the who & the what's be chosen UPON them (dismemberment within the womb, for example).

And, so, conservatives have to point out, "Well, ya know 'to choose' is a free-floating intransitive verb and by you, oh, cultural liberal, not integrating what's being chosen upon whom, you get away with mass murder with a statement like that!"

So, what's the parallel here with your subtle statement?

You say:

Yet you subtly ignore exactly what the context is! Well, of course "We should expect 16 year olds to behave more as adults than children" and of course "A 16 year old is more like an 18 year old than like a child"! Except what's the context here?

Finish the sentence, Nik! Stop leaving us with free-floating intransitive verb-type of sentences which only serve as euphemisms for cultural liberalism!

So YOU are claiming that "We should expect 16 year olds to behave more as adults than children" regarding sex outside of marriage and regarding having people of inherent trust (missionaries) sexually interact with the locals? Really?

(Never mind that we don't know the details of how much force or coercion was used upon the 16 yo)

And you're claiming, Nik, that when it comes to sexual exploitation outside of marriage, that we should simply consider that 16 is "close enough" to adulthood?

Well, hey, Nik, why bother with any of these "arbitrary" laws...
...Why stop at 18 re: drinking laws when 16 is "close enough?" (And hey, if 16, why not 15? 14?)
...And parental consent for abortion & other "medical" procedures? (Hey, we'll just throw that out the window for teens; and, actually, in most states, we already have!...Well, for the 'sacred' act of abortion, that is!)
