Utah man sentenced for crime committed on LDS mission in Chubbuck

POCATELLO — A Cedar City, Utah, man convicted of felony injury to a child stemming from inappropriate contact with a 16-year-old child in 2012, was placed on probation Monday and sentenced to spend the next 10 days in Bannock County Jail.

Derrick Starley was serving a mission for the Church of Jesus Christ of Latter-day Saints in Chubbuck when the incident occurred. He was originally charged with sexual battery of child 16 or 17 years old...

Starley pleaded guilty to the reduced charge in early November as part of a plea agreement through which prosecutors agreed that they would not oppose probation but also said they would likely ask for local jail time.

JaNiece Prices, assistant chief deputy prosecutor for Bannock County did just that. She said that based on the presentence investigation report and psycho-sexual evaluation, Starley did not appear to be a substantial risk to re-offend, but that he did need treatment for an addiction to pornography.

She asked Sixth District Judge Robert Naftz for local jail time and that the treatment be a part of Starley’s conditions for probation. She also recommended Starley’s probation be a lengthy term to assure he has time for that treatment.

The victim’s father then spoke to the judge, conveying the depth to which the incident has affected the victim and their family. He then said the family has forgiven Starley and only hopes that he gets the treatment he needs.

The judge sentenced Starley to serve 10 days in the Bannock County Jail in addition to the five days he spent in jail when first arrested, meaning he will spend Christmas in jail.

“You affected people by your conduct,” Naftz told Starley. “There has to be some kind of consequence so you understand.”

Just a minor nitpick... I think it is rather misleading to refer to a 16 year old as a “child”. We should expect 16 year olds to behave more as adults than children. A 16 year old is more like an 18 year old than like a child.

And a thirteen year old is more like a sixteen year old ("adult", to you) than a ten year old. And so pedophilia is made reasonable in twisted minds.

Before painting the 16yo victim as the responsible adult here, how about a thought for the responsibility of the predator. Or are we changing the goalposts on what constitutes rape as well?

The most conservative estimates indicate that Joseph entered into plural marriages with 29–33 women, 7 of whom were under the age of 18.
The youngest was Helen Mar Kimball, daughter of LDS apostle Heber C. Kimball, who was 14. The rest were 16 (two) or 17 (three).
One wife (Maria Winchester) about which virtually nothing is known, was either 14 or 15.

If I was teaching a class on how to spot and respond to cultural liberals, your comment here would be an excellent example for pinpointing subtle craftiness re: cultural liberalism.

What do I mean?

Well, to be "pro choice" is a fine thing in a free country; UNLESS, of course, we're talking about the who & the what's be chosen UPON them (dismemberment within the womb, for example).

And, so, conservatives have to point out, "Well, ya know 'to choose' is a free-floating intransitive verb and by you, oh, cultural liberal, not integrating what's being chosen upon whom, you get away with mass murder with a statement like that!"

So, what's the parallel here with your subtle statement?

So YOU are claiming that "We should expect 16 year olds to behave more as adults than children" regarding sex outside of marriage and regarding having people of inherent trust (missionaries) sexually interact with the locals? Really?

(Never mind that we don't know the details of how much force or coercion was used upon the 16 yo)

And you're claiming, Nik, that when it comes to sexual exploitation outside of marriage, that we should simply consider that 16 is "close enough" to adulthood?

Well, hey, Nik, why bother with any of these "arbitrary" laws...
...Why stop at 18 re: drinking laws when 16 is "close enough?" (And hey, if 16, why not 15? 14?)
...And parental consent for abortion & other "medical" procedures? (Hey, we'll just throw that out the window for teens; and, actually, in most states, we already have!...Well, for the 'sacred' act of abortion, that is!)

We weren't talking about drivers licenses, or the process of readying teens for mature adults.

The context was...
...sexploitation...
...possible/likely? force & coercion...
...a person in a place of trust (a missionary) misusing it for either of the above mispurposes...

I mean even if somebody knew the specific circumstances here & tried to tell us that somehow there was a tad element of "mutuality" here...which, btw, LEGALLY isn't possible since "consent" isn't legally recognized when it comes to a minor's sexual activity with adults...if somebody says to me (like your keyboard mouth did):

...that's still a subtle form of advocating sexual experimentation outside of marriage.

In Laura Ingalls Wilder’s books, which are semi-autobiographical, her father would not allow her to marry until she was 18. Thus it can be said that the average woman was past 21 when entering her first marriage, 100 years ago.

I am wondering how old the missionary was and what was the sex of the 16 year old.

Consensual sex, when there is an age difference of a mere 2 years, 18 months, or less, is not considered abuse. It could be that the missionary was 18 and the other teen was 16 and nearing the age of 17.

I need to know more before shouting “SEX ABUSE” for all to hear.

There simply isn’t enough information in this article for me.

Religion shouldn’t be a factor in this. It would depend on the nature of the contact and the ages of the two involved. It is possible that the missionary was treated more harshly because he was a representative of a religion. Perhaps if he was just an ordinary guy, nothing would have come of this.

Addicted to porn, therefore deserving of a light sentence. It wasn't his fault he sexed up a 16-year-old. This, ladies and gentlemen, is why we have Mandatory Minimum sentences and reduced prosecutorial discretion.

She writes about neighbor girls who married at 13 and 14.

Several years ago, Ansel12 posted a LOT of FR stuff showing that in the UK, the average age for a woman marrying between 1851 and 1890 was just under age 26. In New England, the average marriage age in MA 1850-1860 was age 23.6. In Vermont in 1858 it was 21.4. Two other table charts were shown in which one had the average age for 1750-1890 at about age 22 -- only dipping down below that for one decade --1870-1879 (21.7 yrs).

One other table showed the average age for women marrying in 1650 was 20; 1750, 23; 1850, 24; 1950, 20.

Now it is true that in sections of New England, more teens in late teens and early 20s started marrying around the Second Great Awakening (1790 --> early 1800s).

But whatever perceptions people have of those marrying young were simply anecdotal exceptions, and not as common as cultural myths have portrayed them...Otherwise, the avg. age of marriage would have been in the late teens...due to the fact that not as many women as today waited to marry later in 20s and 30s...

It would be interesting. These things with children tend to be sealed pretty tightly. Even if he only felt up a 16 year old, 10 days seems a bit light.

From what I posted in #38, in Idaho, anyhow: "Sexual acts, not amounting to penetration, with a minor who is less than 18 years of age but at least 16 years of age are legal in cases where the defendant is less than 5 years older than the victim.[229]"

The victim in this case was 16...if it was less than "penetration," this wouldn't have even been prosecuted in Idaho unless the perp was 21 & over.

The overwhelming ages of Lds missionaries in 2012 (when this occurred) were 19 & 20...tho some were older.

(The allowance for 18 yo didn't occur til 2013)

BOISE – Reuben Delgadillo, a former Caldwell police officer and school resource officer, was sentenced today to serve three to 10 years in prison for felony injury to a child.

Delgadillo, 27, pleaded guilty on June 1 to one count of injury to a child. By pleading guilty, Delgadillo admitted that while serving on a school expulsion board, he developed a sexual relationship with a male student while mentoring the child, according to the Idaho Attorney General’s office.

Delgadillo was employed with the Caldwell Police Department and assigned to the Caldwell School District as a school resource officer.

Third District Judge Thomas Ryan also ordered Delgadillo to pay $5,000 in civil penalties, according to Idaho Attorney General Lawrence Wasden. The court suspended the prison sentence and retained jurisdiction for 365 days.

The Attorney General’s Special Prosecutions Unit conducted the prosecution at the request of the Canyon County Prosecutor’s Office.

EMMETT, Idaho - A former Emmett Police officer charged with two felonies after he police-issued gun went off injuring three people has been sentenced.

Kim Judy was in Gem County court Monday and pleaded guilty to one count of felony injury to a child. The state will recommend two years of probation and no jail time. She had been originally charged with two felonies.

How old was the missionary? Was the missionary 18?

Not 18...crime occurred in 2012...

Lds Church didn't allow 18 yo missionaries in 2012.

There was no charge of a sex crime

Yes, there WAS a charge of sexual battery, a felony. Charges reduced to child abuse.

Here's what all likely happened:

1. Victim was a 16 yo Mormon girl.

2. If perp wasn't 21 (if he was 19 or 20), then no charges would have even been filed if no actual "penetration."

3. Because of #2, sexual battery charge WAS filed.

4. Lds bishop involved probably encouraged victim's family NOT to see this thru a trial...more embarrassment to church; perhaps not in best interest of victim; and perp would have to register the rest of his life as a sex offender.

5. Victim's family apparently agreed to that. Charges reduced to "felony injury to a child"...still a felony...still rooted in his sexual perp act...but a plea agreement.

[Jeff Head lives in Idaho & is Lds; wonder what he thinks of all this?]
