Judge allows gay marriage in Utah to continue

SALT LAKE CITY (AP) - A federal judge has allowed gay marriage in Utah to continue.

Judge Richard Shelby on Monday denied a request by the state that sought to halt gay marriage until the appeals process plays out.

The same judge overturned Utah's ban on same-sex marriage Friday, ruling it is unconstitutional.

So if gays can marry under the 14th amendment and equal protection then can’t tax-payers sue for unequal treatment by the tax code?

Where are the FR lawyers.

His wikipedia bio says a wife and two sons.

But just think, in our brave new world as defined by Utah federal judges, a bi person could have one spouse of each gender. Or more.

Whatever, this ruling is an in-your-face display of abject judicial tyranny in a supposedly conservative state so I guess Texas isn't safe either.

Shelby was newly appointed by Obama. No state is safe until they wise up and use the Constitution.

The Federal Government is not one ring to rule them all.

The states created a monster and have never tried reining it in. It's time. Past time.

It isn’t a government of the people, by the people, for the people anymore. Radical, America-hating activists are running the show now. If they don’t like it, the American people can shove it. It isn’t their government anymore.

That's why there is now only one recourse, if the decent, honest, moral people left in the USA are willing to do what needs to be done......

What’s the next move

Viennacon, I think the next move is for Freepers to read books. As the comments here show how misinformed some are about the federal judiciary.

Secondly, it sure would help if the church-going folks in the heartland would stop electing DEMS to the US Senate ... but they fail to see the connection to gay marriage and the following people:
Pryor-arkansas
Donnelly-Ind
McCaskill-Mo
the 2 Dems from MT
Hagen-NC
Heidi-ND
Tim-SD
etc.


So blame the voters in Montana for giving us gay marriage. it sure would help if our candidates talked about judges instead of rape during the campaigns. The DEM Senators are the ones who are raping us.

Then again, Scott Brown was the lone NO vote on Kagan in the north ... and Freepers turned on him.

But u r correct. Expect the 10th Circuit to provide a stay within 24 hours.

This is a federal judge appointed by Obama. I don’t think that’s going to happen.

I hope your right. My point is one of state’s rights. Do you not agree that under the original constitution, which is the authority over any judges decision etc., that the state AG has the right to halt clearly extrajudicial rulings by a federally appointed goon, and prevent activists from distributing illegal marriage licenses.

Wrong. The time for reading books and pointy-headed punditry is over with. The time is now for action.

The people of Utah had their say, and a black-robed tyrant thinks he knows better than them. Now, that may very well be the system as it's come to be interpreted/misinterpreted/misused/abused, but it's not right. King George's law was also legal, but it wasn't right, and the Founding Fathers knew good and damn well it wasn't.

If a group of states wants to do nullification and defiance, I am all for it, but I am not going to hold my breath waiting.

They will cave. The political class is not interested in this issue and the people who are interested are not interested in being part of the political class.

logically, the Senate can be regained with a very small shift in membership (only a few seats)... of course, this does not account for the Democrats-In-R-drag like McCain who have supported the Kenyan usurper all the way...and who can probably be counted on to defend him in an impeachment too?

There’s no formal Roe v Wade on this from the Supreme Court yet, but the rulings earlier this year on DOMA and Prop 8 gave the public and other judges their leanings (5-4 for gay marriage), so these rulings are coming down.

In addition, Justice Scalia said the court majority was demonizing the people who oppose gay marriage. That’s something with implications that are even more dark and sinister.

The GOP keeps raising taxes and increasing spending so I don’t see grassroots conservatives supporting them in the future.

I saw 36 GOP senators opposing that tax and spend budget deal last week, but for most of them it was a show.

House leadership like Paul Ryan and John Boehner took the lead on that dirty budget deal, with most House Republicans (73 percent) going along.

The Republican leadership and business as usual Republicans from McCain to McConnell offer no hope on fiscal issues, much less social ones.....
