A Florida orthodontist sued the Obama administration on Tuesday, insisting that the White House must abandon changes it has made on its own to the Affordable Care Act, instead obeying the letter of the law as Congress passed it.

The administration has made several tweaks to the Obamacare law, including a one-year delay of a measure that requires companies with 50 or more employees to offer them health insurance or pay financial penalties.

The law specifies an exact date when that feature is to go into effect – January 1, 2014 – but the White House announced in July that it would push that date back, angering some in Congress who saw the move as a unilateral power grab.

The lawsuit, filed by Dr. Larry Kawa, claims that the regulatory changes violate the Administrative Procedure Act and go beyond President Obama’s constitutional powers.

I’ve been wondering when this suit would be filed. I think it’s a winner, although they will probably find some way that no one has “standing” to challenge Obama’s unlawful actions.

Good to see. All avenues need to be used. Some weaselly judge will find everything lawful based on the hundreds of ‘the secretary shall...’ in the law. Basically, the legislative branch has relinquished their own power to the executive branch. Hopefully the five Supremes will restore order.

...there are now 1,472 waivers to 0Care...(where's our exemption?), and...that the law being rolled out today is NOT even the same law that was originally *passed* (forced). In other words, they're enforcing a law that was not even passed.

I heard Betsy McCaughey's interview with Mark tonight. 'Brilliant' is exactly right. Congress gave Obama one law, but he's enforcing something of his own creation. Something that he has no authority whatsoever to do.

This is a position that the Republicans in Congress need to take up immediately, and push every chance they get. Obama is using the ACA as a sort of template to do whatever the hell he wants, while calling it "the law". It's no such thing.

Standing seems to be a tough thing to get when it’s Obastard.

Real live Electors (from the Electoral College) who cast the official, constitutional votes for President in 2008 were denied standing, and they had to vote for him! If the Electoral College doesn’t have standing to sue Obastard over the Birth Certificate issue, who has standing for anything?

I’m afraid the good Orthodontist is not going to get anywhere with this. But I certainly wish him good luck.

The obamacare exemptions go against everything this country stands for. If the law isn't good enough for the politicians, it certainly isn't good enough for every other American. The laws are for all Americans, even the filthy pigs in DC who are our servants.

Seems right. I think this goes back to the Supremes assuming they ruled on the original bill. Obamas changes impact the character of the original bill.

This needs to go out to ALL Pubbie's, immediately. The dims and McShamer's keep saying "it's the law of the land" to "get over it, it's the law" or "elections have consequences"...they are categorically wrong. What's being enforced, beginning today, IS NOT THE LAW!

Why do we always ascribe superhuman skills to the enemy? They’re in a bind. Obama’s out and Reid’s out saying “No Compromise”. Along comes the GOP House and compromises, over and over and over again.

At some point the Dems have to break. Then what? What will Obama do? Veto it again? Eventually, it ends up on his lap.

Relax.

Have you seen Obama’s latest polling numbers. He was weak in 2012 and cheated his way to victory. He’s crippled now and Obamacare will seal his fate. We need him to take the Dems with him. Take care.

Obamacare as it's being applied is a violation of the EQUAL PROTECTION Clause of the United States Constitution.

It's HIGH TIME someone brought a lawsuit on those grounds.

The Small Business Administration’s Office of Advocacy created from this Law:

Small Business Regulatory Enforcement Fairness Act (SBREFA)

is what to search for more info.

I expect Ted Cruz and Mike Lee to pick this up and run with it pretty quickly. In addition, conservative talk radio needs to start hammering it day and night, until Obama and the Dems choke on it.

We've got to use everything in our arsenal to stop this beast, and this one is a MOAB.
