Onondaga County Family Court Judge Michael Hanuszczak today sentenced a 16-year-old to 18 months of confinement for the killing of a 51-year-old man.
The sentence was the maximum the judge could have handed down to the teen, who was recently found guilty of second-degree manslaughter in the beating death of Michael Daniels. The boy was 15 at the time of the incident and has maintained his innocence since his arrest at the end of May.
The judge, who is required by law to sentence a juvenile delinquent to the "least restrictive available alternative consistent with the child's needs and best interests and the need to protect the community," said he made his decision based on a variety of factors.
Those included a sentencing recommendation from the probation department, as well as a review of the boy's school records, which showed a history of truancy and suspensions that involved threats and intimidation of his teachers, he said.
Hanuszczak ordered that the 16-year-old not be given credit for the time he has served at the Hillbrook Juvenile Detention Facility while awaiting his trial and sentence.
An OCFS intake specialist attended today's hearing, and explained in court that the teenager will be transported to a "reception" facility in Brooklyn within the next two weeks. He will then undergo a series of tests, including psychological and psychiatric examinations, to help determine his risk level and the appropriate state facility to best treat his needs.

Daniels was standing alone on the corner of West Brighton Avenue and Cannon Street when he was approached by at least two teenagers and beaten to death. Several witnesses testified that around seven or eight teenagers were present during the incident, and that the beating happened after someone suggested the group play a street game called "knockout."

I’m beginning to believe that being approached by a group of black teens on the street is a good enough reason to use deadly force all by itself.
The judge gave him the maximum, which is nothing, and it’s pretty clear his hands were tied. What’s the point of having judges if they’re forbidden from keeping monsters off the streets ?
I guess “hate crime” enhancements never apply to blacks.

County Judge, so perhaps county law, otherwise it would come from Albany. The problem is that the laws for juveniles amount to a slap on the wrist. If the crimes are heinous, there should be no distinction between a child or adult. The feral animal didn’t just steal a pack of Juicy Fruit gum.

How come activist Judges can legislate from the bench when it suites their agenda but when it comes to crimes such as this they are forced to honor maximum sentencing laws?

Though this organization worked for organized crime, there is no reason in the world that it might not live again, but this time to carry out acts of revenge and vengeance when the courts have failed to properly punish violent criminals.
Even in the last few weeks, there has been several examples of grotesque miscarriages of justice. This 18-month sentence for homicide is just another. Other examples:
“A Yellowstone County district judge Monday ordered a former Senior High teacher convicted of raping a 14-year-old female student who later committed suicide to spend 30 days in jail. Judge G. Todd Baugh sentenced Stacey Dean Rambold to 15 years in prison, with all but 31 days suspended, for sexual intercourse without consent.”
“In Rhode Island, 18-year-old Josh Maciorski was convicted of having sex with a 13-year-old girl, but sentenced to probation. Two years later he molested a 14-year-old girl and served just one year. Then, when he got out, Maciorski raped a 16-year-old girl. His sentence after this third strike - an unbelievable three years in prison.”
“In Missouri, 19-year old Darrell Jackson pleaded guilty to repeatedly sexually abusing a little girl, beginning when she was just eight. But when Jackson came up for sentencing, a soft judge gave him four months in prison and five years probation.”
“In Minnesota, Joseph Duncan stood in front of a judge, accused of molesting a young boy. Despite the fact that Duncan had previously served 16 years for raping another young boy at gunpoint, the judge released him on just $15,000 bail. Duncan promptly skipped bail and headed for Idaho, where he allegedly kidnapped, raped, and killed a 9-year old boy, molested his sister, and killed their family.”
If judges keep doing things like this, the almost inevitable result will be “contract vigilantism”, not just some upset person trying to hire some low life to kill a villain; but an organization whose purpose is to seek out those whose victimizers have escaped with little or no punishment, and with or without their permission to execute vile criminals.
If done discreetly and professionally, this occupation might well be like that of an insect exterminator, wiping out the cockroaches that infest a home.

As I told some people over thirty years ago, after a similar case in which some white teens murdered a Navajo, sit back, wait till they are released, then one day they just disappear.
The desert is a BIG place.
funny how that works....activist judges can rule on your life in every possible way yet try to get a little justice for one dead man, not a chance....
