Lavabit (email service) owner fears arrest for non-compliance after secret surveillance order

The owner of the encrypted email service used by former NSA contractor Edward Snowden says he could face criminal charges for refusing to comply with a secret federal court order issued last week.

Ladar Levison abruptly shut down his company, Lavabit LLC, last week to avoid being forced to hand over customers’ personal information and communications.

James Trump, a senior litigation counsel at the US attorney’s office in Alexandria, Virginia, contacted Levinson’s lawyer on August 8 - the day Levinson ended Lavabit’s services, NBC News reported. The attorney was told that Levison had “violated the court order,” leading to speculation that he may be charged with contempt of court.

In 1474, Peter von Hagenbach was put on trial for atrocities committed under his command but not by him directly.
Hagenbach defended himself by arguing that he was only following orders.
His defense was rejected, and he was convicted and beheaded.

The claim used by nazi defendents during the Nuremburg trials that "an order is an order" (Befehl ist Befehl)
was also rejected by the court.

In February 1945, Aleksandr Solzhenitsyn was arrested for writing derogatory comments in private letters to a friend about the conduct of the war by Joseph Stalin.

He was accused of anti-Soviet propaganda and “founding a hostile organization” under Article 58 paragraph 10 and 11 of the Soviet criminal code.

Solzhenitsyn was taken to the Lubyanka prison in Moscow, where he was interrogated.

On 7 July 1945, he was sentenced in his absence by Special Council of the NKVD to an eight-year term in a labor camp.

Actually, the erosion of the constitution began long before Bush.

The 16th amendment, allowing the federal government to collect income taxes, passed in 1909. This gave tremendous power to the federal government that was never intended by the founders.

The 17th amendment, allowing direct election of senators, was passed in 1912. It eroded states rights.

When the progressives found that they could amend the constitution to prohibit alcohol consumption (even though it was later repealed), they knew they were off to the races. If you can get an amendment to alter people's behavior to that extent, you can do anything.

Later amendments to allow women the vote, and to extend the vote to 18 year olds brought two huge voting blocks into play who would be easy for progressives to manipulate.

You can blame Bush if you want, but this trend started over a century ago. The blame goes all the way back to Woodrow Wilson, democrat, racist, progressive.

Under a legal amendment process, Americans have morphed their representative republic into a mobocracy. Empires rise and fall, see Rome. I figure we are at about 230 AD and heading fast for a fall.

I’ve had a security clearance continually since I was 18 years old - 45 years. In no instance where I was made privy to an official secret with a validated need to know did I do so without having been first required to sign an agreement beforehand which stipulated the requirements and penalties - and the term for which I was responsible for this.

The government cannot walk up to you, tell you something ‘super secret’ and then ‘threaten punishment’.

They have to brief you beforehand get your signature on something that acknowledges you know what’s what. Legally, that is. If they are operating outside the law like this then they are traitors, our enemy.

If they did this to me and I had not signed anything I’d tell them “f@ck you”. I don’t care if there is a Patriot Act, or if there is a FISA court - they can take me to Guantanamo or wherever then, but I won’t comply.
