Rubio: Obama will ‘basically legalize’ 11 million by executive order if immigration reform fails

Florida Republican Sen. Marco Rubio warned Tuesday that some on the Republican side of immigration reform could come up empty-handed if the Senate’s “Gang of Eight” plan fails.

In an appearance on WFLA’s “The Morning Show with Preston Scott” in Tallahassee, Fla., Rubio explained that President Barack Obama will be tempted to enact his own immigration reform measures by executive order if Congress does not pass an immigration bill. An Obama executive order would legalize 11 million undocumented immigrants, he said.

“I have been saying now for over a year I believe that this president tempted, will be tempted, if nothing happens in Congress he will be tempted, to issue an executive order like he did for the DREAM Act kids a year ago, where he basically legalizes 11 million people by the sign of a pen,” Rubio said. “We won’t get an E-Verify, we won’t get any border security — but he’ll legalize them. So what I have tried to do is come up with as best as possible, given who controls the Senate, a way to start this conversation to at least address some of these issues because it only gets worse as times goes on.”

It is Rubio’s job to protect the Constitution

It’s Rubio’s job to stop the President from doing this and he should do so on constitutional grounds. Not by expecting us to go along with his own Faustian deal

If th pres would be acting within the confines of the constitution then there would be no problem with this

The GOP is complicit whoever does not oppose this on constitutional grounds. They will be blamed

And the way BO operates, they will be the only ones blamed

Rubio will have his name and comb over all over this for generations

Let me play the devils advocate for a second.

Doesn't Obama (or any president)have a duty to ensure that there is no second tier citizenship status in this country? If congress won't act to ensure equal protection under the law, isn't it the duty of the president to make it so? Didn't Lincoln set precedent with the Emanciptation Proclamation?

Leave the border security question aside for a moment and I believe that with this Supreme Court, Obama has some legal grounds here on this amnesty question and I wouldn't be surprised if the democrats come full force with the Lincoln / Slavery / EP argument.

Shame on the spineless governors who will not act with the same impunity that Obama does!

I agree.

At the very least, Rubio shows a complete misunderstanding or lack of respect for the separation of powers.

He's just going to roll over and die if Obama oversteps his bounds. Pretty gutless.

Show me where in the Constitution it's the function of the Executive branch to ensure "fairness" and I'll agree with you.

In my opinion, Rubio is a tragic figure. He explains our economic system--the market one, not the modified Marxism of the Obamanists--better than most other contemporary Republican Senators; but his position on immigration is indefensible, and shows a major misunderstanding of what is even fitting for a beneficiary of American hospitality.

While I fear that Rubio has already persisted in this folly too long to be politically resuscitated, I would still urge his constituents to have the sort of conversation with him on immigration, recommended earlier in Whither American Conservatism?

Please, do not anyone imagine that I am advocating that we compromise one iota on the immigration question. Certainly not! My gentler rebuke for Rubio is not a suggestion of any retreat on an issue absolutely essential to the preservation of the America won on the battlefield. But we need to try to win over anyone we can--that is try to bring Rubio to our position, not his present totally unacceptable one..

And Rubio's Senate immigration plan would 'basically legalize' 11 million by blanket amnesty (they are calling it something different this time -- protective status or some such, but a rose by any other name ... amnesty by any other name ...)

So, what is the difference, Marco?

Beside, they already have defacto amnesty because neither Congress nor the executive branch will enforce existing laws. So, what good are more laws going to do?

Well then let him do it. Let him be the one who gets the ire of the American people. Why in the hell do GOP seem to like draping albatrosses around their necks as if it is their responsibility to run point for bad left wing crap? What is happening is they are depressing their base and its starting to negatively affect the prospects for races this year and next.
