DENVER — A Denver judge refused to stop recall elections for two Colorado Democratic senators who supported gun restrictions, even though the lawmakers are challenging the validity of the petitions.
Denver District Court Robert Hyatt made the decision Thursday afternoon.

The ruling judge Hyatt was appointed by a Dem so it must butt hurt the Dems even more. No doubt the DUmbs are going to push this to the State Supreme Court where I believe they have even a lesser chance to win there. :-)

‘Judge Robert Hyatt ordered Gov. John Hickenlooper to set a date for the recall elections of two Democratic senators sometime within the next three months.
“The liberal construction required of recall statutes weighs against rejecting recall petitions on hyper-technical grounds,” Hyatt, chief judge of Denver District Court, said as he ruled from his bench following a day of testimony and evidence.”
Senators John Morse, D-Colorado Springs and Angela Giron, D-Pueblo, would be the first state legislators politicians to appear on a recall election ballot.
But the election will likely have to wait until challenges to the legitimacy of the petitions makes their way through the legal process.
Hyatt’s ruling will likely be appealed and could eventually go all the way to the Colorado Supreme Court - delaying the election for weeks or even months.
Attorney Mark Grueskin said he and his clients will consider the outcome and decide whether the Supreme Court should hear and rule on this case.
Hickenlooper could set the election date anytime between Aug. 17 and Sept. 30 under the new timeline, El Paso County Clerk and Recorder Wayne Williams said.
Williams said he had requested Sept. 10 and the governor is considering it.
Hyatt was asked to determine whether the petitions circulated to thousands of voters in the districts for Senators John Morse, D-Colorado Springs and Angela Giron, D-Pueblo, met constitutional requirements to force a recall election.
Hyatt said the petitions were indeed sufficient, in part because it’s a constitutional right to recall elected officials and interpretation of requirements should lean in favor of the citizens. “

Indeed Hickyloop is out of excuses; he set the elections dates for Sept 10th.

Speaking strictly as a Coloradan: representatives of the Democratic [sic] party have a great deal of experience at stalling. It's not going to do them a speck of good.
