Rep. Steve Stockman Tells Boehner To Kill Senate Amnesty Bill With ‘Blue Slip’

Following the passage of the Senate’s amnesty bill, Representative Steve Stockman (R-TX) sent a letter to House Speaker John Boehner. In the letter Stockman requested that Boehner immediately kill the Senate’s bill, S. 774, though a constitutionally-required ‘blue slip’ resolution.

A ‘blue slip’ is a resolution that automatically returns to the Senate any bill that violates the origination clause of the United States Constitution.

Blue slip resolutions are immediately considered as a matter of constitutional privilege, are debatable for an hour and are not subject to amendment.

“Not only is the Senate amnesty bill an abuse of taxpayers and immigrants, it’s utterly unconstitutional. The Senate cannot invent its own amnesty taxes,” said Stockman. “I hope Speaker Boehner will immediately kill the amnesty bill through a constitutionally-required blue slip. As long as the amnesty bill sits in the House it poses a threat to taxpayers and immigrants.”

Several provisions of the Senate amnesty bill create new taxes, a violation of the “origination clause,” Article I, Section 7, Clause 1 of the United States Constitution, which states “All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.”

Section 2102 of the amnesty bill requires the payment of certain taxes and forgives the payment of other taxes as a condition of receiving amnesty and other benefits. The Constitution prohibits the Senate from approving bills that raise revenue.

Stockman also points to the Congressional Budget Office, which flatly states “enacting S. 744 would have a wide range of effects on federal revenues, including changes in collections of income and payroll taxes, certain visa fees that are classified as revenues, and various fines and penalties. Taken together, those effects would increase revenues by $459 billion over the 2014-2023 period.”

Because frankly, the senate rarely screws up this badly.

Generally, the Senate takes a house bill they don’t like which included some revenue items, and their first step is to “amend” it with a replacement. Then, whatever they do, they are simply “amending” a house bill, so origination is not an issue.

But here, they started with the bill in the Senate. So once they added revenue to it, they violated the constitution.

The beauty of this approach is twofold. First, it is a simple majority vote, without much time to mess around. Second, by declaring the senate bill invalid, there would be no bill to “reconcile” later. The senate would have to pass some other bill first. Which would likely mean the senate taking the house bill and amending it.

The thought just occurred to me that two events may actually push us to the brink of Civil War:

Blue Slip rejection by the House, of the Senate Amnesty Bill (via Shumer's threat of riots in the street by Illegals)

coupled with

Blacks rioting in all major U.S. Cities in protest of a "Not Guilty" Verdict in the George Zimmerman Trial.

Americans may FINALLY realize that the Illegal Inter-lopers, coddled by Progressives, AND the inner-city tribal parasites (coddled, supported, Taxpayer-dependent, drug-dependent, and lawless) will BOTH hit the streets and it will be "Game On" for all those who value the REAL American way of life and former Constitutional/Law-abiding populace.

I live in Stockman’s district so I got Cruz as Senator and Stockman as Rep. I get the warm fuzzy’s just thinking about it. Kinda makes writing letters moot. I send emails to congratulate them ever so often.

First, almost all of the proposals Congress puts forth is Unconstitutional these days.

Yes, sigh. We could take them to court for violating our constitution, but sadly as just, "citizens" we all lack STANDING to seek redress for our grievances against illegal acts committed by our brilliant, elite and fashionable noble class of betters infected with greed and power.

We have no party nor representation anymore.

It seems to me that this approach offers a number of advantages:

1. It KILLS THE BILL
2. It will remind everyone that we still have Constitution
3. It puts the Harry Reid Senate back into its place with a VERY LOUD b!tch slap
4. It makes it clear that no more of these Senate bills will be tolerated by the House
5. The American people will be transfixed by the news coverage
6. The Republican party will gain a lot of respect
