Two defendants in military sexual assault cases cannot be punitively discharged, if found guilty, because of “unlawful command influence” derived from comments made by President Barack Obama, a judge ruled in a Hawaii military court this week

Well, well. It appears our “Constitutional Law Genius” is really a jerk when it comes to the Constiution.

That’s o.k. He has no use for most of it anyway.

Wow, what a bitch slap to the big ‘O’.

Despite their despicable behavior, from a political standpoint this is a positive outcome.

Does this mean that ANY military person charged with sexual assault could not be punished?

Sounds like Jug Ears needs to stick to his Beer Summits and stay the hell away from a podium unless he has a telepromter.

This guy continues to impress me with his (lack of) mental capacity...

Well, maybe Barry should back off on the close and personal interference.

I’m sure Big Zero’s comment about Saint Skittles looking like his son will be accepted as grounds to dismiss the case against George Zimmerman. After all, The Big Zero is exercising undue influence on a case.

How can George ever receive a fair trial when the president calls out in favor of one side.

The file for stories ignored by the MSM is getting mighty full.

I don't think this is a "positive outcome," in any way. It's Obama's fault, of course, for sticking his nose where it didn't belong, but it's not a "positive outcome." Even if this is something that can be used against Obama politically, that is a small benefit (with everything else swirling around Obama these days, this one is meaningless) and is far outweighed by the fact that this only benefits personnel who are conficted of despicable crimes.

Essentially, yes, if the defense submits Obama’s statements.

“‘I expect consequences,” Obama added. “So I don’t just want more speeches or awareness programs or training, but ultimately folks look the other way. If we find out somebody’s engaging in this, they’ve got to be held accountable — prosecuted, stripped of their positions, court martialed, fired, dishonorably discharged. Period.””

ironic- of course when it came to the murder of innocent babies by abortionist Gosnell, ayatollah obama would not comment because the trial was ongoing...but lets’ indict soldiers before due course...

I read down in the article after posting that. An Admirals public comments effected 60 cases last year.

This is a get out of jail free card.

Not a SCOTUS ping, but a very interesting ruling related to Obama’s comments on sexual assault in the military. Thought y’all might be interested.

Could you imagine if this was Bush? The story on all the news channels would be either he was so ignorant and stupid he ran his mouth and now two sexual harassers are getting away, or maybe even, this was all a diabolical plot by Bush to get these guys off on a technicality because Republicans hate women.

Where was Obama when the Commander in Chief (Bill Clinton) was accused of workplace sexual harassment, rape, lying to investigators, lying in court, bribing witness testimony, threatening witnesses, etc?

He is a sh!theel for attacking our military as sexist and as potential rapists.

Good find. Link to .pdf of the ruling.

The words that Obama used that were deemed 'unlawful command influence':

“The bottom line is: I have no tolerance for this,” Obama said, according to an NBC News story submitted as evidence by defense attorneys in the sexual assault cases.

‘I expect consequences,” Obama added. “So I don’t just want more speeches or awareness programs or training, but ultimately folks look the other way. If we find out somebody’s engaging in this, they’ve got to be held accountable — prosecuted, stripped of their positions, court martialed, fired, dishonorably discharged. Period.”

Of course the question comes up would those people have been convicted or even charged if it weren’t for Obama’s statements.

His policies have exacerbated the disciplinary problems which exist in the military.

got that right, since all this corruption has started I have been flicking through channels and local media and papers and there is not a peep on most of this by the media.

Example.
sexual assaults on men in the military has reached record levels, and that started when don’t ask was overturned but not a peep about men being raped by men in the military.

IRS, Hell I;ve hardly seen CNN mention that.

Holder, the only time he;s mentioned on MSNLSD is when they are protecting him..

The media is a joke and are not even asking where is Obama and why was he meeting with homosexuals and cross dressers in the white house while he sends out his scapegoat to tell the world we will get involved in Syria
