Jury hung on two counts in Philadelphia abortion trial

PHILADELPHIA (Reuters) - A Philadelphia jury in its 10th day of deliberations told the judge on Monday that it was hung on two counts in the murder trial of a doctor accused of killing babies and a patient during late-term abortions at a clinic that served low-income women.

Dr. Kermit Gosnell, 72, who ran the now-closed Women's Medical Society Clinic, could face the death penalty if convicted by the jury in Common Pleas Court in Philadelphia.

The seven-woman, five-man jury, after taking the weekend off, resumed deliberations at about 8:30 a.m. and sent out a handwritten note about 90 minutes later.

The note said it was hung on two counts, according to one of the attorneys in the case.

Gosnell is charged with four counts of first-degree murder for delivering live babies during late-term abortions and then deliberately severing their spinal cords, prosecutors said.

He also faces charges that he performed 24 abortions after 24 weeks. It is legal in Pennsylvania to abort a fetus up to 24 weeks into a pregnancy.

In addition he faces charges of conspiracy and more than 200 counts of violating the state's informed consent law for abortion which mandates a 24-hour waiting period.

The jury heard five weeks of testimony and has been deliberating since April 30.

Gosnell's defense contends there is no evidence the babies were alive after they were aborted.

Testimony depicted a filthy clinic, serving mostly low-income women in a largely black community.

Gosnell is also charged with murdering Karnamaya Mongar, 41, of Virginia, who died from a drug overdose after going to him for an abortion, prosecutors said.

Gosnell has been in jail since his January 2011 arrest.

what is the racial make up of the jury? that is far more important than the gender make up

The racial makeup of the victims would probably mirror the racial makeup of the jury. It's not like he was catering to a white, middle-class clientel.

How about "at a clinic that overdosed, hacked, and horrendously injured poor, mostly black pregnant women, with some of their babies being poisoned or smashed in the womb, and some decapitated afterwards." "Served." Reminds me of the cartoon of the cannibals with the banner, "We serve humanity."

If the jury is black any conviction will be for minor offenses.

Most, if not all, of the babies were also black so really it should not matter; they should be as horrified as if it was a white jury with white babies.

Blech, people are so brainwashed. How could there be a hung jury? So they approved of babies swimming in toilets trying to survive? Soulless.

yeah, I know it is how convinced they were—beyond a shadow of a doubt.

That may well be true, but I live in the Philadelphia area and am friendly with many Black Philadelphians. I can tell you the name Gosnell is synonymous with the Devil. Young, old, Obama lovers all (or most), it doesn't matter. Gosnell's seen for the evil that he is.

That would indicate it does in fact happen. If I had used the word “never”, then you could approach my post from the direction you took. Since I used “rarely”, you could just attempt to prove you have some deficiencies in open forum.

Perhaps. But from what I’ve read and heard, it’s difficult to comprehend the jury being hung for any reason, other than saving a brother from the man.

I guess we’ll find out when it’s all done? You could well be right. I’m not in Philly, so I don’t really know. I’m working with what I see go on around NE Ohio, and national reports.

Hang him? Yah,right.You wanna know what will happen if he's convicted? A Rat governor will receive a petition on hardship grounds claiming that this serial killer is deathly ill and will grant the petition.Kinda like Doctor Death...who,it was claimed,was at death's doorstep when he was released on compassionate grounds (by a Rat governor)...managed to last 4 years.

It’s ok. When you prove yourself to be less than intelligent, it’s human nature to respond with the charge that the person exposing you has the same deficiency. It’s a defense mechanism. Your lack of insight, creativity or basis for your charge is quite telling.

It’s anybody’s guess. I just read the latest and the story in today’s Inquirer is ambiguous. It says the jury is hung on 2 counts, but that 250 counts remain. 250 counts remain for what? For deliberation? It’s unclear.
