On the other hand, Bloomberg reports a bit of bad news in the ruling that could concern all bloggers:

“The U.S. Court of Appeals for the Ninth Circuit sealed the fate of copyright enforcer Righthaven LLC today by ruling that the minima; “right to sue” copyright assignments that Righthaven acquired from newspaper publishers did not confer standing to sue third parties for copyright infringement.”

“So far, that’s good news for bloggers and others who had been targetted by Righthaven. However, the Ninth Circuit’s ruling contained a bit of bad news for them: along the way, the court vacated the lower court’s ruling that the defendant’s posting of the entirety of a copyighted article to an online discussion board was a protected fair use.”

Excellent news. My solution to the Las Vegas Review-Journal quandary was not only to never post an article from there, but never go to their site for any reason and let everyone I know not to go there.

Reminds me of the LA Times. Used to go to their site daily but once they came down on FR, I rarely go there. Maybe once a year at the most.

It’s really a shame that none of the defendants who settled with them are able to have their fraudulently stolen money returned to them. I know of at least three websites that settled with them for undisclosed amounts. One of them was truly a tiny kitchen-table business, and I don’t know how she survived it.

You know you’re on shaky ground when even the 9th Circus wont even agree with your case. Court turned their attempted sueage into sewage.
