Federal death penalty attorney to defend Tsarnaev

BOSTON, April 30 (UPI) -- The lawyer who saved Tucson shooter Jared Loughner and Unabomber Ted Kaczynski from the death penalty was assigned to defend the alleged Boston Marathon bomber.

San Diego criminal defense attorney Judy Clarke has the "background, knowledge and experience" that will "enable her to provide adequate representation" to suspect Dzhokhar Tsarnaev, U.S. Magistrate Judge Marianne Bowler said in a ruling.

Clarke will join three other public defenders -- Miriam Conrad, Massachusetts' chief federal public defender, and two assistant public defenders -- in defending Tsarnaev, 19, who faces charges of using a weapon of mass destruction and malicious destruction of property resulting in death.

In her ruling Monday, Bowler denied, at least for now, the request for death-penalty specialist attorney David I. Bruck to join the defense team.

Bruck teaches law at Washington and Lee University law school in Lexington, Va., and directs the school's death-penalty defense clinic.

Bowler said Clarke's "qualifications demonstrate she is 'learned in the law' of capital cases."

They don't even know who all the victims were yet ~ but there's a couple of Saudis in the list and their custom is to take care of business hand to hand, knife to knife if what passes for government can't.

Any lawyer looking at a list of 500 injured and dead has got to pucker up real bad as it sinks into them how many ENEMIES they have acquired. With a 1.2% Schizophrenia rate, minimum, that would be 7 people who hear voices eh!

American taxpayers paid for his welfare to support this killer and his family. Now we taxpayers are paying for a team of high priced lawyers to defend him and help him escape justice. It broke my heart to rad about the 10 year old boy killed and the others who died and lost limbs. Now I watch as my money is used to support these people.

I have no problem with a law professor (who doesn’t actually practice law or operate in the real world) being appointed to defend this scumbag. I am surprised to learn though that W & L is a refuge of liberal ideology.

I would never, ever, accept a “high profile attorney” from the government, because they are often ‘ringers’, sent in to appear to put up a good defense, but guaranteeing that the defendant will be convicted.

This is done because of the “enthusiastic amateur” attorney problem. Some bright, ambitious young attorney might actually be able to derail a trial where the government absolutely wants a conviction, no matter what.

And that sort of thing happens, and not just in the movies.

And they do not want that to happen, so they fix the trial.

Loughner and Ted Kaczynski were both liberals... Judy Clarke did a good job keeping that information from the press... Oh wait, forgot - the press didn't want to know... 'if it doesn't 'fit' you must omit'...

This attorney is well know for ‘one thing’...avoiding the death penalty for those she represents....not so much if the person is guilty...but getting them life rather than death.

Her focus will be to create enough “confusion or uncertainty and doubt”.....it takes just one jurist to swing to life in prison.

She has won in most of her cases....they get life.

I have no doubt they may do a deal....rather than the government spending the money to “protect and defend” this guy....it’s going to cost “Millions” to the tax payer.
