Famed death penalty foe named to Tsarnaev defense team

The defense team representing the Boston Marathon bombing suspect got a major boost Monday with the addition of Judy Clarke, a San Diego lawyer who has won life sentences instead of the death penalty for several high-profile clients, including the Unabomber and the gunman in the rampage that injured former Arizona Rep. Gabrielle Giffords.

Clarke's appointment was approved Monday by U.S. Magistrate Judge Marianne Bowler.

The judge denied, at least for now, a request from Miriam Conrad, the public defender of 19-year-old suspect Dzhokhar Tsarnaev, to appoint a second death penalty lawyer, David Bruck, a professor at Washington and Lee University School of Law.

Tsarnaev has been charged with using a weapon of mass destruction during the April 15 marathon. Three people were killed and more than 260 injured when two bombs exploded near the finish line.

The suspect's lawyers could renew their motion to appoint another death penalty expert if he is indicted, the judge said.

Tsarnaev's brother, 26-year-old Tamerlan Tsarnaev, also a suspect in the bombing, died after a gun battle with police. Their mother has staunchly defended them, calling the bombing allegations against them lies.

Katherine Russell, Tamerlan Tsarnaev's widow, is not a suspect in the bombings and has not been charged in the plot. However, FBI agents met with Russell at her parents' Rhode Island home Monday to collect a DNA sample, CBS News correspondent Bob Orr reports.

The fix is already in.

This was apparent when a federal judge made a special trip to read him his rights... effectively shutting down the FBI’s investigation.

Make no mistake about who is defending this terrorist.

she will successfully get rid of the death penalty because they did not Mirandize a US citizen right away and as soon as a Judge waltzed in and did give it to him...he shut up.

I understand that constitutionally he’s entitled to legal representation and that the government has to provide it if he can’t. But I don’t think that he should be entitled to the attorney of choice if he isn’t paying the bill. If this Conrad is getting paid then it should be at what a federal defense attorney would be making, not at her normal rate of a bazillion bucks an hour.

I may be wrong, but doesn’t the prosecution have to ASK for the death penalty in the first place? Who exactly is going to do that in this case? I assume liberal Mass. doesn’t have it. That leaves it up to the Obama/Holder DOJ - yeah, right.

By virtue of the Obama/Holder paradigm, he now has certain privileges other criminals don't, the first being he is a criminal.
