A federal judge said this week that the Obama administration is likely violating the law by telling immigration agents and officers not to arrest illegal immigrants they deem low priority, in a case that could upend President Obama’s enforcement policy.
For the last several years the administration has said it will no longer arrest most illegal immigrants, arguing it wants to focus only on those with serious criminal records or gang ties. The Homeland Security department said it was using “prosecutorial discretion.”
Immigration agents and officers sued, saying federal law requires them to make the arrests, but the Obama administration would discipline them if they complied with the law.
Federal Judge Reed O'Connor said in a court order Tuesday that Congress, not the president, sets priority for arresting illegal immigrants, and said the law requires them to be put in deportation proceedings.
“The court finds that DHS does not have discretion to refuse to initiate removal proceedings,” Judge O'Connor wrote.

The only real authority to act is the ‘power of the purse strings’. That is in the House. Unles the House acts by withholding funds, the WH can continue to do damn well what they please.

Contrary to popular belief, the three branches of government are not equal. The legislature is intended to be the most powerful with the executive secondary. The judiciary was intended to be the weakest branch.

Obama could care less about what any judge says. The law is what Obama says it is or isn’t. He’s King Hussain.
Importantly, appeals from this judge go to the 5th Circuit, which has 1 judge from Carter, 2 from Clinton, 2 from Obama, 4 from Reagan, and 6 from GW Bush. So 5 Democrats and 10 Republicans.
So if appealed, the odds favor this policy getting slapped down hard.
As ong as we have a no spine congress and an accomplice in the WH judges will be the go to branch.
However, how many divisions does the supreme court have? Or cops for that matter.

That freaking bites my backside. I was just told I was ineligible for my Medicare premiums to be paid because I didn’t provide a bank account. I don’t HAVE a bank account. So I am going to be farther below the poverty level than I already am so some effing alien can get my money, even though they can’t speak-o Engrish.
The bad thing is, my rent will be same, as will my expenses, until the COL goes up. Then I will have even less money to try to exist on.
