Lindsey Graham: ‘Enemy combatant’ (In Spades!!!)

Several Republican lawmakers are calling for the surviving suspect in the Boston Marathon bombings to be tried as an enemy combatant, rather than as an ordinary criminal.

“It is clear the events we have seen over the past few days in Boston were an attempt to kill American citizens and terrorize a major American city,” read a Saturday statement from Sens. Lindsey Graham (R-S.C.), John McCain (R-Ariz.), Kelly Ayotte (R-N.H.) and Rep. Peter King (R-N.Y.). “The accused perpetrators of these acts were not common criminals attempting to profit from a criminal enterprise, but terrorists trying to injure, maim, and kill innocent Americans. The suspect, based upon his actions, clearly is a good candidate for enemy combatant status. We do not want this suspect to remain silent.”

Their statement came after Dzhokar Tsarnaev was taken into custody and sent to the hospital Friday night.

We must never lose sight of this fact and act appropriately within our laws and values.”

“There are no grounds...”

Sure there are grounds. What is the point of the oath he just swore last year if he cannot be held accountable to it? He got citizenship under false pretenses, that would be my “grounds” for stripping him of it, and its cloak of protections.

I would agree with you if he was natural born and swore no oath, but that is not the case.

I'm with you Lindsey. After all some, but not all kinds of waterboarding can actually be fun. As noted, there are exceptions. How is the surfing in Cuba? Time to find out.

This is illegal. He committed no federal crime (constitution doesn’t allow for it unless he’s being charged with Treason).

That won’t stop them from following the law though which is a shame.

One day they’ll come for us.

I don’t like it but this one is an American citizen caught on American soil. This only serves to weaken our constitution further.

Agree...too bad there isn't a probationary period for new citizens.

His would certainly be revoked and then....let er rip!

You can’t strip someone retroactively. He was a citizen when he committed the crime. He may lose the citizenship if convicted but that’s irrelevant.

He did not commit a federal crime and this is a dangerous path.

I don't know, he did use what could be deemed a WMD against American Citizens, that is definitely a federal issue.

Something to consider....

until proven guilty

He already proved his own guilt. Now lawyers will come in to unscramble it as to try to prove not guilty and they will fail and at a cost to you and you keeping him warm, fuzzy, mat and all. Get caught up - there is more than a 30 sec video.

I take a strict view on this... unless it’s treason...

They will however use some federal law passed by a previous corrupt congress which is wrong and hypocritical for liberals because now they can seek the death penalty in a state that has banned it and is against it

While I approve of the sentiment, this is Grahamnesty and McQueeg we’re talking about. This is damage mitigation for their “Gang of Ocho” plan of amnesty of illegal aliens, nothing more.

I saw a couple of law professors smirking at this "loony" notion on CNN this morning... "He's an American citizen."... "Committed a crime on American soil."... "Not some enemy combatant we picked up on the battlefield in Afghanistan."... yadayadayada (Never mind that these same professors were probably opposed to treating Gitmo prisoners as enemy combatants)...

But I have to ask, what if an enemy army secretly invades America (which is exactly what's happening), stopping by the INS to pick up their citizenship papers on the way to the battlefield? Do we have to Mirandize them, too? Without asking the smirky profs, I'm pretty sure I know what their answer would be.
