I’m no lawyer; however, just because someone did not shoot a federal employee doesn’t mean he didn’t commit acts of terrorism. Aren’t there statutes against terrorist activities that have been used to prosecute, and do some of them not carry the possibility of the federal death penalty?
If you start from that premise - and I’m just asking - he could be threatened with a federal death penalty unless he sings. If he sings adequately, the death penalty threat could be withdrawn in favor of life in prison.
He will be tried in federal court for terrorism charges.

I understand that he was unresponsive when in the boat...it was ‘infared from the helicopter’ that located where he was and movement. So he didn’t surrender.
