AMHERST, N.Y. - A state lawmaker is calling for an investigation into how an Amherst man's guns were taken away by mistake.

State Assemblyman Ray Walter says when he saw the news coverage of David Lewis' case, he knew immediately something was "seriously wrong." Walter wants some answers, when he meets face-to-face with the State Police Superintendent in Albany next Tuesday.

Lewis said, "It's been very embarrassing. I feel like I've been let down, and my privacy's been invaded."

Lewis was forced to turn in his seven handguns and stripped of his pistol permit. After State Police in Albany identified him - instead of a different David Lewis in another county - as being too mentally ill to own them.

Lewis' attorney, Jim Tresmond, suspects investigators are using the SAFE Act, to pry into confidential medical records.

"We hear that there's a special unit that's been created to peruse the HIPAA reports," Tresmond said.

Walter added, "Or else this was just a test case on the part of the Governor's office, to see how far we could push this law.

BREAKING: Sources close to law enforcement have told me point-blank that Drama Queen Governor Andrew Cuomo's NY State Police are LYING about making a "mistake" in the case of the 35 year old Amherst man whose pistol permit was suspended and his weapons ordered surrendered to Amherst PD.

Keep reading...it gets worse.

The citizen involved was called MULTIPLE times on his PRIVATE phone numbers (including cell) by Sgt. Jackson of the NY State Police, according to sources.

In other words: The NY State Police did not make a "mistake." Contrary to their deceitful and prevaricating statement, they had exactly the person they wanted.

Of course the NY State Police brass and the political butt-lickers in Stetson's don't lie, right?

I'd suggest you read up on the attempted cover-up of the causes of death of the Attica Prison Riot hostages who died as the prison was retaken.

State Police tried to intimidate the Monroe County Medical Examiner and other ME's during autopsies by hovering over the autopsies in 1972. The goal? To tell the public that inmates killed the hostages during the retaking by cutting their throats. Guess what? They lied.

Returning to 2013: Informed individuals tell me that Cuomo's Gestapo were relentless in their contacts with Erie County officials.

State Police were shocked that the local man RETAINED COUNSEL, and by the national firestorm generated by my show which was picked up by Glenn Beck's site, Drudge and Rush.

And it gets WORSE: Within the past 12 hours, another even more sinister development took place in Albany.

Your constitutional rights are not safe in NYS. That is all I can say right now.

The seed that was planted today is SO dastardly that if even half of what I am hearing is correct, Drama Queen Governor Andrew Cuomo will be forced to resign and see his name added to the list of the most execrable political figures in NY history.

1. I have always, and always will support police in the performance of their constitutionally authorized duties, and will claim a grade of A+ in my support of cops for 30 years.

2. I have never been arrested or convicted of any offense whatsoever, and have not even been pulled over in 13 years and that was for a broken headlight.

Why do you think they started medicare and the prescription drug program? So they would have easy access to the records.

Rebellion in the NY State Police PBA!

Numerous sources have come forward this weekend to tell me that rank and file members of the NY State Police PBA are outraged by "NY SAFE" and by UNION LEADERS who refuse to poll rank and file members regarding this onerous law.

I have been told by multiple sources that at least 90% of NY State Troopers are in deep opposition to "NY SAFE" and want THEIR union to issue a statement opposing this violation of our rights.

PBA leadership won't do this.

Union honchos have told troopers not to "rock the boat" during contract talks with NY State and want the rank and file to keep their pie holes shut about Drama Queen Cuomo's despotism and intent.

BUT numerous rank and file troopers have stated that they will gladly forego a pay hike to support the 2nd Amendment.

There is a movement in the NY State PBA to oust current leadership because NUMEROUS Troopers believe the union does not speak for them.

Also, I have been communicated with by State Trooper rank and file from Troop A (our area) and the Thruway (T-Troop) troopers from our area and across the state.

Their common themes to me?

1. Tom: the rank and file thanks you for what you are doing against NY SAFE.

2. Tom: we are scared of what is going on in NYS and the USA but we cannot talk openly. Thank you for having the courage to take on these powerful people.

3. Tom: we have your back and don't worry about the PBA leaders, brass or the Cuomo butt-kissing goose-steppers.

4. Tom: you are correct. Politically-oriented troopers would sell their own kids for a seat at the table of power, and are a small minority and everyone else on the job knows who they are.

I have talked about my own dissonance as a well-known and long-time supporter of law enforcement in the approach that has been forced upon me by illegal laws.

Friday, the dam broke and I have had more contacts with LEO's who are on our side.

I am honored that the rank and file troopers trust me, yet I am disturbed because they NO LONGER TRUST THE GOVERNMENT or their own UNION.

They know the powers ranged against me, they know how the game is played and they have pledged to support our freedom by leaking info and DOCUMENTS and by watching my back.
