NYC appeals ruling striking down soda size limit

New York City is asking appeals judges to reinstate a ban on supersized sodas and other sugary drinks, which was struck down by a Manhattan judge the day before it was to go into effect.

The city had vowed an appeal and said Thursday that lawyers had filed it late Monday.

In his decision on March 11, State Supreme Court Justice Milton Tingling said the 16-ounce limit on sodas and other sweet drinks arbitrarily applies to only some sugary beverages and some places that sell them.

Is the big gulp soda really the most compelling health issue in NYC? Will a ban really impact anything? Has government gotten to the point it really wants to micromanage soda consumption? This is what city lawyers want to clog the courts with? Does Bloomberg have any idea that 99 percent of the citizens think he’s a jackass?

Because NYC just can’t waste enough of their taxpayers money trying to control them! I bet the Clymer in charge would love it if he had control of their groceries from the store to their door!

It’s not about health with him, it’s about asserting his power. He bans smoking, soda, eating, guns, and everything else under the sun (0n average he bans something new once a week) yet he constantly promotes bike riding which kills more and more people every year, the most famous death being the sister of Alan Dershowitz who was crushed by a UPS truck around 2 years ago.

Answers in order: "No". "Yes - every time a ban like this goes into effect, a bit more freedom is lost and politicians become a bit more powerful". "Yes - the government wants to micromanage every part of our lives". "Why not - lawyers care more about billing and double-billing than what's right". "No, but if he wasn't so full of himself to be able to miss that he's a jackass, he wouldn't really care because he can always impose a ban on that kind of thought".

If Bloomberg were smart, he’d let the ruling stand. By appealing it, he’s keeping it in the news.

It would be nice if the appellate court would give Bloomberg a real lesson such as not only upholding the lower court ruling, but by striking down some of the mayor's authority to regulate, in general.
